mitch_lcfc_1993 Posted 3 September 2012 Posted 3 September 2012 I have just got back from work to open a letter saying I owe £95 for a parking fine. I parked on Stone Lake Retail Park, and now have a fine to pay. I will admit that it is my own fault for not checking how long you were allowed, so has anybody else received a fine? Surely they must of made thousands that night, because there was hundreds of cars trying to get out after the game, so do I pay the fine or appeal it? I think it is stupid that the government do this, but anyway, any help would be much appreciated. Come On Leicester!

Stuliasz Posted 3 September 2012 Posted 3 September 2012 If it's a retail park, it will be whoever the retail park owners have employed to police the car park who issued you the parking ticket, not the government. Unless you have a very good and strong case to appeal (such as proof of inadequate signing etc.), I'd suggest not wasting your time and paying as in a lot of cases, the fines increase if you appeal and lose.

Halfsy Posted 3 September 2012 Posted 3 September 2012 Don't pay it, as the parking ticket you've received sounds like it has nothing to do with a council or government and therefore they can't punish you for not paying. If you check the parking ticket, I'm pretty confident that it will be an invoice rather than a fine. That is what I got when I received a fine for parking in a Morrisons car park for too long. I didn't pay it and didn't hear anything from them.

What does that mean? Another company will track you down for the outstanding money. the point about it being an invoice & not a fine is a valid one

These companies have no official right to fine you, though they may try to make you think they do. All they're doing is sending you a notice for what they deem as a breach of contract. When you parked there, you entered into whatever contract is on a sign on a wall somewhere, by stopping too long you breached that contract and this is the outcome by involving a debt collection agency, they get a proportion of the debt from the agency, who in turn will make a profit by getting the full amount off you Here's a good technicality Phone them and say you weren't driving, you don't have to tell them who was and they'd have to go to court to prove it was you which they'd never do because it would cost them too much, that could prevent them passing it on to a debt collection agency

Won't they just pass it onto debt agency then, which may have power for ccjs or whatever unless I'm mistaken

Did they ticket any other people who parked there for the football? Because unless they ticketed everyone, they're going to have a very hard time proving to the court that the fine should stand when they've not ticketed everyone who used the car park.

There were signs on the walls saying a new parking scheme had been introduced and I, because it had never been there previously, took no notice. I got stung with a ticket on my window and a fine. I contacted the Council and they said it was a private arrangement set up by the pub to stop people parking there and shopping in Blaby. They said that many people had got similar fines. They advised me to pay the fine, which I did.

DON'T PAY IT. This. They'll be writing to you for a year or two but the trick is not to make any contact with them whatsoever. They have to prove you were driving. They also have to prove you saw all the signage which was displayed 'adequetely' They also have to prove you understood said signage and had appropriate time to reflect and agree entering into a legally binding contract. If anybody can find me an example of a private company making a successful car park related prosecution in this country I'll be surprised. In a years time they'll still be writing to you saying they'll do you a deal if you pay 35 quid! All letters that you receive will say 'may' or 'could' result in legal action - not 'will' because they would need to sucessfully prosecute which they won't achieve.

What does that mean? Debt recovery companies have no real power, for instance they can't kick your door down and enter your house like court appointed bailiffs can. All they can do is enter through open doors and windows. They take a list of your property and have to take you to court for it. As long as they don't get a look inside your house to take a list of what saleable property you have they can't do anything. Unfortunately, as you have been billed for parking, they know you have a car and can take you to court for the car to recover their money. You can take the risk of not paying if you wish to because sometimes it is just an empty threat and they drop it instead of passing it on to a debt recovery agency. Bear in mind though that unpaid debts can affect your credit rating

Save yourself months of stress and worry and most probably a lot more money and just pay it, Don't let it become a lingering nightmare. Swallow it, and get it paid.
