What's the maximum sentence for this type of manslaughter anyway under the law as it stands? I could find a lot of guidance to no specific sentence parameters.

Here is the misconception of manslaughter.

Manslaughter and murder are really only legal distinctions, in essence they are the same thing and it is something only prosecutioners need worry about when concerned with what they need to prove. Importantly for the general public, both offences have the possibility of a life sentence, the difference is if murder is proven (with intent) then it is a mandatory life sentence: symbolising that being proven to intentionally kill someone is the worst of all crimes. Manslaughter is different only in that a judge has a discretion, looking at all the circumstances of the case; they can still pass a life sentence but this is unlikely if the CPS has not been able to prove actual intent, reflecting the fact that it's ""not as heinous"".

*Disclaimer*: I think!

To Lou, the CPS will have either struggled with, or predicted struggling to prove intent, actual or malicious, OR the offender will have successfully argued a diminished responsibility (mental breakdown) or a provocation (retaliation loosing self-control) defence. The boy throwing the glass at the bakery tried to argue provocation but it was obviously rejected, had he been successful he'd likely have got a similar sentence to this other case.

Tax discs: this will probably be a strict liability offence so the mere fact you've not got one displayed, paid or not, is enough to get you f'ed in the ass, your "state of mind is irrelevant" just whether you ave physically complied or not. Just wait for the postman if possible.

EDIT: also Thracian, yes it is common thought that the law is too confused and piecemeal, when I studied it 2 years ago I think they were considering MASS reform. I think, but someone correct me if I'm wrong, that homocidal law is purely a common law area and has not been put into statutory form? I'm not sure how close they are at reforming it all but we may soon see changes especially to the sentencing of offenders and how judges are to be guided if at all.

Like Benji says, they have been looking to bring in a homicide act, but it hasn't happened yet. That's what they told us, anyway!!

So my tax on my car ran out at the end of March. Me being an idiot forgot to renew it in time and yes I did recieve the renewal notice, but for one reason or another it got at the bottom of the pile. >_<

Anyway ive been driving around the last few days with no tax oblivious that my tax had ran out until yesterday when It suddenly struck me.

I have now purchased my next 12 months online and wont receive it for a few days.

My question is will I receive a fine in the post for driving around without a tax disc, considering I drove past a police car on a couple of occasions without being stopped but I know there anpr systems alert them of drivers without valid tax.

So shall I expext a fine in the post or am I just worrying for no reason? In hindsight Im suprised I didn't get stopped. My old man reckons they will fine me but other people have said they have to physically stop me?!

And lastly can I drive without a tax disc until my new one arrives or is this illegal?

Ye if you have paid for the tax but not recieved the disc yet you shouldn't get a fine through the post bar a major cock up but you just need to make sure you have proof that you have paid for the tax renwal incase the police stop you
