I'm no legal eagle (or indeed any sort of bird of prey) but if you look at cases where there have been prosecutions they invariably involve a situation where someone has clearly overstepped the mark, for example our friend Tony Martin who allegedly shot a burglar in the back who was running away, or that one where those two brothers chased a burglar down the street, caught him and beat him half to death. Every case is different but I think the way they're treated is fairly consistent. I think the problem's more about people wanting to dish out their own justice, which is understandable because it's an emotive issue and I don't think anyone wouldn't be upset to have their home violated in that way, but that's just not for us to do. That's what the courts are for

Some people want a law where anyone who enters your property illegally loses their rights as soon as they enter, but that's open to all kinds of abuse. You'd end up with confused, lost ramblers getting shot because they're accidentally on someone's land. I'm sure you could get something a little more refined than that but the law we have at the moment is the best compromise all round. However you word it otherwise is open to misuse.
