CAR CRASH MAN'S JAIL TERM CUT BY STAFF REPORTER 10:15 - 23 October 2006 A dangerous driver who smashed into a car carrying a mother and her baby son has had his jail sentence substantially cut on appeal. Winston John Cook (37), of Seagrave Close, Coalville, already had an "appalling record" of convictions for driving offences when he crashed while fleeing from police on May 16. Cook was jailed at Leicester Crown Court on June 22 for two years and three months after pleading guilty to dangerous driving, driving while disqualified and using a vehicle with no insurance. Last week, Mr Justice Henriques and Mrs Justice Gloster, sitting at London's Criminal Appeal Court, cut that sentence to one year and nine months, saying the sentencing judge had been too harsh. The court heard Cook, who had five previous convictions for dangerous driving and 30 for driving while banned, had been spotted by police who recognised him as being a disqualified driver. He fled and crashed his Ford Escort in the woman's car, leaving her with whiplash and friction burns. Her eight-month-old son escaped unharmed. Cook abandoned his car after the crash, but was tracked down when he was spotted cowering in undergrowth by officers in the force helicopter. His defence solicitor, Joanna O'Connell, told the court: "His addiction to driving vehicles is like a drug - he gets a thrill from driving. "He wants to have counselling which can address his problems, so he does not get the same thrill from driving. "The defendant is also remorseful for the impact his actions must have had on the victims' family." Allowing his appeal on Friday, Mr Justice Henriques said: "The previous convictions are horrendous and include numerous driving offences. "Reports noted that his motivation to address his offending behaviour and continued drug use was low. "The judge was right in saying this was a very serious case of dangerous driving. "Nonetheless, we think that he didn't give adequate discount for the fact that the appellant had pleaded guilty. "One-10th discount was not sufficient and was not compliant with the guidelines. "This sentence was manifestly excessive and we will allow the appeal."

As i've said on numerous occassions, the law is too soft on prisoners and sentencing at times is a joke and the disparity between the crime commitd and sentencing is also a joke!!! This decision will nit be a deterant for future or current criminals!!!
lookwhaticando Posted 23 October 2006 Posted 23 October 2006 With that number of previous offences, he should have been locked up for 5 years and banned from driving at all for 10 beyond that. How can someone who offends repeatedly so much get his sentence cut by so much? He clearly flouts the rule of law all the time - 30 convictions for driving while banned! Insanity.

People are expected to leave justice to the courts and I'm all for giving people a chance but he's taking the piss out of the system and the courts are taking the piss out of the victims."

With the way this country's going, I should be fine. Especially when I employ some imaginative accountant to look after my earnings....
