Socks Posted 23 July 2014 Posted 23 July 2014 I know this isn't the Martin Lewis forum and this is a Bit of a strange post but wondered if anyone knew the laws on this. We have some old lock ups next to our house used by some plumbers and in the wasteland next to them they burn their waste. The smoke engulfs our house and we have shut our Windows to stop us choking on the fumes. This happens once a week I have smelt plastic being burned too. They say what they are doing is legal Before I go to environmental health are they telling the truth?

We will investigate complaints regarding bonfires on commercial and industrial premises if we think they could constitute a Statutory Nuisance. Waste produced during the course of normal business activity should be disposed of in an appropriate manner. Disposal by burning is not permissible and will also be referred to the Environment Agency for investigation. http://www.leicester.gov.uk/your-council-services/ep/environmental-health-licensing/pollution/bonfires/ I would imagine other councils have the same rules.
The Guvnor Posted 23 July 2014 Posted 23 July 2014 You have to have a licence to burn waste, wouldn't be issued to some cowboy plumbers in a residential area so they are talking bollocks. As suggested contact E H and tell them what is the most likely time they will be burning their waste as they should send a representative round to investigate.

Orkneyfox Posted 23 July 2014 Posted 23 July 2014 basically no. (from an ex EHO and Ex Scottish Environment Protection Agency man). There are some exemptions from the rules but if you can smell burning plastic then they are breaking them even if they have registered what they are doing> in ay case they have to do it so as not to cause a nuisance. Environmental Health Dept at Nottingham Council is where you want to go first. If it is a waste licensing issue they may involve the Environment Agency.
