yorkie1999 Posted 19 September 2016 Posted 19 September 2016 Although I don't do either, I think having a screaming baby in a car seat is far more distracting than using a mobile phone whilst driving.

But if the police think you’re distracted and not in control of your vehicle you could still get stopped and penalised. thats from gov.uk and my point was I don't think a lot of people know that so be careful , and your right You can get done for driving without due care and attention, just for driving without care and attention. The wolds gone mental!

Certainly in my younger years i would get up and drive at 6 in the morning having only got in at 1-2am and think nothing of the fact i felt groggy or hazy. It never occured to me that it was dangerous or illegal. Yeah I'm sure drink driving was fine in the old days

Not all cases are going to follow the same processes. I have heard of people getting off over the evidential machine 'not being calibrated' or a word during said alcohol procedure being missed. I guess its rare however some solicitors are very good at picking up on these things.
