It also mentions that your boss would have a right to make sure work tasks are completed. I would not be surprised if one company interprets that as being able to check how much time you spend messaging/ contacting others outside of work contacts...

His employer had discovered that he was using Yahoo Messenger for personal contacts, as well as professional ones. Because it believed it was accessing a work account, the judges said, the firm had not erred. If it's a work account, the employer is probably classed as the account holder, therefore they can access any information on that account. I very much doubt they'd have any legal standing to access information held on a private account. They can ensure work tasks are completed without hacking employee's personal accounts.
