My memory is different as i believe they had planning permission but it was time based and that time ran out, their legal appeal was re not being able to renew/continue with the original planning approval, but I could be wrong.

The original LCFC application included retail units but was subsequently removed as that was legally precluded (as Morrisons discovered).
