Rincewind Posted 25 March 2014 Posted 25 March 2014 I am saying it is an over reaction because the laws of GB will not be changed in favour of a small minority.
The Doctor Posted 25 March 2014 Posted 25 March 2014 Muslim Judges and muslim jurors for drawing up wills? Have you even read the article? no point reading the article, it's incredibly misleading, this is just a practise note: http://www.lawsociety.org.uk/advice/practice-notes/sharia-succession-rules/#sharia12 with the key point being: 1.4 Status of this practice note Practice notes are issued by the Law Society for the use and benefit of its members. They represent the Law Society's view of good practice in a particular area. They are not intended to be the only standard of good practice that solicitors can follow. You are not required to follow them, but doing so will make it easier to account to oversight bodies for your actions. Practice notes are not legal advice, nor do they necessarily provide a defence to complaints of misconduct or of inadequate professional service. While care has been taken to ensure that they are accurate, up to date and useful, the Law Society will not accept any legal liability in relation to them. For queries or comments on this practice note, contact the Law Society's Practice Advice Service. Islamic law is not being adopted.
Rincewind Posted 25 March 2014 Posted 25 March 2014 I thought it was unlikely that it would be adapted which is why I never read it.
Webbo Posted 25 March 2014 Posted 25 March 2014 I thought it was unlikely that it would be adapted which is why I never read it. But you still commented on it as if you were an expert on the subject.
Guest MattP Posted 25 March 2014 Posted 25 March 2014 No idea where to start here. The actual article. Muslim jurors. The point being made. The difference betwen adoption and adaption. Other Issues. Tough one.
Rincewind Posted 26 March 2014 Posted 26 March 2014 But you still commented on it as if you were an expert on the subject. But you still commented on it as if you were an expert on the subject. But you still commented on it as if you were an expert on the subject. Did I? I offered an opinion. I am no way an expert. I said I thought it unlikely.that laws would be changed to suit a minority. I stand to be corrected if that is wrong.
Trav Le Bleu Posted 26 March 2014 Posted 26 March 2014 Does anyone know how wills are currently drafted? Can you exclude your wife and or kids from inheritance currently for whatever reason? I always thought you could do what you want with your money when you die. Or is this in the case where a formal will hasn't been written, and a muslim dies it is to be drafted in accordance with Sharia law? When I heard this, that was my attitude too. I'm pretty sure that you don't have to give a reason why you have given your money/belongings/property to any specific person/persons and that it's happened both ways that women have left all their stuff only to the women in the family and men to the men. So what happens when you leave all your worldly possessions to one person (pretty sure you can do this?) Can you argue that this is sexism, unless that person is a hermaphrodite? And surely the law doesn't need to be changed to reflect this anyway?
Nick Posted 26 March 2014 Posted 26 March 2014 People can contest the wishes of the deceased anyway, however the Law Society's willingness to work with a value system that promotes mainstream inequality seems deeply flawed on first glance and may endanger their reputation moving forward.
