The Year Of The Fox Posted 25 April 2014 Posted 25 April 2014 Has anyone any experience in the above? I along with a couple of others and their bosses are considering applying for compensation from our college due to loss of earnings as a result of their inadequacies- I for example have overran the course by what will be a year in July, at the expense of a £4 per hour wage rise. I'm not American and I do realise it sounds like an utter fantasy but we do have some grounds to make a complaint. To explain any further would take til this July itself so I'll leave it at that. Cheers
AndWhat? Posted 25 April 2014 Posted 25 April 2014 Thinking about taking a lettings agents in Wrexham to the small claims court over them screwing me and my fiance over. Had a quick look and it only costs about £100 I think. I imagine it to be a bit like Judge Judy.
Charl91 Posted 25 April 2014 Posted 25 April 2014 I imagine it to be a bit like Judge Judy. While that would be nice, I doubt it a lot, since Judge Judy isn't a real court. I bet in real life it's a lot less fun.
notnow john Posted 25 April 2014 Posted 25 April 2014 http://www.bbc.co.uk/news/business-27138429 This will give you a good idea of the current state of the small claim system, originally set up to give everyone recourse to the law.

I hate lettings agents and I'd take great pleasure in giving you advice on how to smash them.
AndWhat? Posted 26 April 2014 Posted 26 April 2014 Ooh, tell me more. I hate lettings agents and I'd take great pleasure in giving you advice on how to smash them. To explain everything would take me a week! Long story short..... we have had to move back into my fiancées parents house and have lost £800. They have done nothing but lie to us and the branch manager is the rudest woman I have ever met in my life.

I would make lettings agents illegal - there's no point in them. I'm currently in the process of renting a house and I've had some bad experiences. When it's all gone through, I shall name and shame some of the c unts individually on here, explaining why I hate them.

Cheers For loss of earnings, your claiming damages on the inadequacies of the party at fault. There, they must in breach of the agreement you have in place. Small claims are more suited to obvious money claims due and owing. For example, a loan agreement whereby A is expected to pay B a certain amount per month but fails to so so. The county court runs through them pretty quickly in a day. Get your agreement, a chronology of events and sit down with a litigation specialist. Remember, litigation is very costly and lawyers charge but the hour. Therefore, get the advice first. If is a clear breach, run with it. If not, your loss has to be a clear result of the other parties breach. For example, are they negligent? If so, have they failed to display the correct duty of care etc. Read your terms and conditions or whatever other agreement you have and establish whether the agreement supports what you are looking for. Oh and on the other points in this topic, letting agents and estate agents are scum of the earth! The most unregulated, disgraceful profession in this country!
Captain... Posted 30 June 2015 Posted 30 June 2015 Has anyone used them, either making a claim or on the receiving end. What was the cost in the end? Were you successful? Having a dispute with my letting agency at the moment that might end up there, so just wondering if anyone has had any experience and can pass on any advice. Cheers.
AndWhat? Posted 30 June 2015 Posted 30 June 2015 Have you been to the Property Ombudsman yet? Could be a cheaper option

I havent but I did rent my house out while living in Italy and the tenants caused a few issues, The letting agents told me they nearly always favour the tenant over the landlord so you might be ok.
The Year Of The Fox Posted 30 June 2015 Author Posted 30 June 2015 You have to have made an attempt (and proof) of trying to settle out of court first that's all I know
