Anyone get the train to So'ton?

Good find Ched, but just to note, all stop and searches are subject to the provisions of PACE Code A, so they can ask you to remove outer garments (coats or jackets, gloves etc). It is also an arrestable offence not to submit to the search, and there doesn't have to be any reasonable grounds for suspicion.

I am looking at this as part of my degree at the moment. The powers under s60 are very wide in some respects, and the infringment on civil liberties in respect of this provision winds me up, especially in view of the stats we were given. The data for stop & searches in general show that 11% result in an arrest, and there is a conviction rate of 44%. This includes penalty notices issued for carrying cannabis. What isn't known is how many of the arrests are for assaulting a police officer in the execution of his duty, an offence that would no doubt would not have been committed had the offender not been stopped in the first place.

But what seems to be the deal most of the time is a fan realising the rights he has and exploiting them. This results in the Police officer becoming pissed off he's been rattled then arresting the guy for been drunk and disorderly or whatever he can come up with.

When it gets to court it's there word against his. We all know how that ends up. Could be why the conviction rate is so high.

So what about Customs Officers. What are they entitled to do and what should a member of the public do and insist on if stopped? :dunno:

Absolutely ridiculous it was.

I was drinking on the way down a little. I was finishing my drink on the platform and there were no bins. I thought If I left it on the floor I'd get done for littering. So I decided to put it under my arm as I went through the gates. When I bought the tickets I was 15. So I got a childs ticket. the bloke pulled me to a side and was going to charge me £108. For some reason he couldn't, thank god.

We helped get a City fan off, in court. He'd done nothing wrong. But that's another story.

If you are stopped, it's always worth asking a copper to you a copy of PACE!!

Customs and Excise Management Act 1979 s164 apparently gives officers the power to search. The C&E website has a guide, but their site is down.
