People probably know I was made redundant, i'm not sure if anyone on here knows the laws, e.t.c, but I understood and was told the company that made me redundant could not employ someone within the next 6 months without offering the job to me first. I was told and have heard a rumour that the company are considering and looking into taking some Polish workers on, but on a temporary contract. Is this allowed?

I was just wondering if there was some loophole that if they took people on with temporary contracts it would bypass me and I have no leg to stand on.

As they aren't British the government will allow them to do it because Labour are racists. If the BNP were in power it'd be illegal and your rights would be protected. ;)

If you're given a redundancy package and you take it then I'm sure thats's the end of it.

Oh, i've not really looked into my rights and stuff, I though regardless of a redundancy package they had to offer a job to you before anyone else if it is within 6 months.

Might just go down Citizen Advice Bureau to see what or if I have any rights.

Well let's say a firm makes 15 people redundant and then decides a few months later they need to employ say 5 people, which of the 15 would get the job offer!

It's a potential minefield for employers hence the redundancy package.

I think the key aspect is that it's under different terms and conditions of employment i.e a temporary contract, more than likely no holiday pay, no sick pay, possibly different hours and you can bet it will be significantly less money, especially as they've more than likely got an agency to pay.

It maybe the same work but in effect it's a different job.

if they change the name of the job role its also classed as a different job apparently so they can do it that way too.

This is the problem I have with the foreigners coming over and taking our jobs, Its a catch 22 though, You can't blame the foreigners if a jobs there, better money, they will take it, It is the employers fault, but then again if there are people out there willing to work for cheap then you can't blame them, however these foreigners coming over earn there money spend nothing here and go home rich men and women, spending no money in our economy and boosting it, thus the down spiral in our economy, English people are out of work and can't afford to work for cheap like the foreigners because living in England simply isn't cheap.

The firm sound like a bunch of wankers anyway, perhaps you're better off out of it. Get yourself backpacking in Australia like you said before. You'll never get a better chance. :thumbup:

I'm sorry but from the experience of this company/the company I used to work for, we employed Poles before I left, although they all went home when the exchange rates went shit and they really weren't any better off working here than at home, and the company gave them a house to live in absolutely free, all they had to buy was food and spent nothing on a whole and went back home a millionaires in their currency.

to be fair quite a few of the people who come here to make money and go back home (which the british did in the 70's/80's in germany) live in a 'lot's of people to one house' scenario. thus having much lower outgoings and can, thus, afford to under cut the british workers who, in the main, have higher outgoings.

rolling your eye's is pointless on this occasion, although i know you like doing it to people, who you seem to view with contempt

So gonna finish work at 1pm tomorrow and get myself straight down Citizen Advice.

I was driving to work today and funnily enough where I have my temporary job it is literally down the road from where the poles house (Which my previous employers own, and let the Poles live there when they work for them) and I saw 2 cars coming out of the drive so text someone who is still working at my previous employers asking if there are any Poles there and they have employed 2 for the moment.

I reckon they will have just got through the loophole of giving them a different job title, however they couldn't give them Labourer as they made a labourer redundant, they couldn't give them Preparation for the Sprayshop, as they made a prepper redundant, and they couldn't give them Bench Joiner as they made me and another Bench Joiner redundant.

My old employers a fucking cunt's.

If I wanted to make a claim it has to be within 3 months of being made redundant...Its been 3 months, They've employed Poles on the cheap, Coincidence? I think not.

Basically my bosses have been Crafty fookers and know how to work the system.

I love how us English are well looked after.

Its not going to make any difference but I reckon i'll just pop in to see some mates there and then see my boss have a talk to him, put him under pressure make him squirm, and make him feel so small, make me feel abit better. Cunt.

We managed to escape a lecture on living in London cheaply from a Kiwi whilst in Wellington. He really doesn't like our attitude to money and consumer products!

Poles are allowed to live and work in the UK as they are now members of the EC. You have just as much right to go and live and work in Poland. Why don't you go to Krakow or Warsaw and go and 'steal' one of their jobs, if it winds you up so much. That'll learn 'em.

Erm, I don't want to go Poland for a start, and what benefit would I get from going to Poland? The currency is worse (Granted any job/money is better than none though) and also why should I have to go to another country to get work or effectively be 'forced' out of my own country to get work?

At the end of the day, these guys will be working for less money than you, and with worse conditions (sick pay, holidays etc). Yes, it's crap you weren't offered that chance first, but it's not just your ex-employer's fault. It'll be the companies who offer them work, but want it at a lower cost, so they then don't have to pass on that cost to consumers who want the goods to be sold in these shops at even lower cost, etc etc.

I was a bloody good employer to them - Within reason I did all the hours they asked, I did all the Overtime they asked, I did the job spot on, I worked through the night many a time, I came in and started work in the middle of the night or very early in the morning for them, I traveled all over the country for them, I asked for many pay-rises they didn't give me them yet I still worked hard for them, I put up with shit from them, and still get no thanks and shit on.

What i'm saying is I have no problems with the Poles, I actually got on with them really well, they were a good laugh, when they come here and millions of English people are on the dole and the country is on it's knees and yet we don't get our jobs offered back - that is when I have the problem and blame the EU immigration policy.

I'm really not sure, I know for a fact these Poles are of agency, I know for a fact they get paid around 6 to 8 quid an hour, So then add the agency fees i'm guessing your looking at around 9 or 10 quid a hour, possibly more? :dunno:

I do understand the rest of what you are saying, although it doesn't matter if the shops are selling things cheap or not if English people are out of work and have no money, cheap products or not they won't be able to afford them.

Its a catch 22 shopfitting is (Which is why I want out of it and looking at another aspect of the trade say Kitchen Fitting or something) because more and more English people are becoming out of work, The employers want cheap workers (Poles), no-one is spending in the shops because no-one has any money, that means they are not having new shops fitted.
