I guess because it's only a pre-order, they can just tell us to fook off. It's in the terms that they're allowed to change the price and cancel the orders. >_<

on places like ebay etc , once a bid is accepted , they claim its a legally binding contract for both parties ,

oh well i'm not too bothered either way, i'll get over it if they say its cancelled

What're the actual laws on them doing that? I know in a shop they have to sell it at the price its advertised at or something so is it the same online? We shall see. Either way if they try and make me pay full price then I'll just cancel it.
I think they HAVE to sell it at the price listed don't they?

I remember hearing about ASDA or somebody accidentally putting crates of stella in a catalogue for 1.20 instead of 12 quid and they HAD to honour it.

You definetly have to sell it at the price listed, be it online or instore.

They actually don't have to sell it to you at the advertised price, even in shops. It's something about it being an invitation to trade and not a firm offer. Therefore you taking it to the counter is the offer to buy it at advertised price, if they realise an error, they can refuse to sell it at that price. Most shops would probably honour it though, just to keep the peace.

With auctions and tenders, the way the contract is formed is slightly different. Only slightly.

I ordered one this morning too. Following a link from another site.

I have a confirmation email stating the price of £9.99. Does that not mean they have accepted my offer?

Yeah, since I made my post I saw the relevant parts in their T&Cs so I'm not keeping my hopes up. Still, it's changed price and I still haven't received an email telling me I can cancel my order or pay the full price so fingers crossed.

Nah, it says in the T&C that they're not contractually obliged to sell it to you at the pre-order price unless they've dispatched it to you. Something along those lines.

It's this kind of question that is going to shake up the glamorous world of contract law. I would say that the offer has not been accepted, as these systems are automated and the T&Cs explicitly cover situations where items are incorrectly priced (to keep things simple).

Some retailers will honour the mistaken price on the basis of goodwill. Others will not.

That's exactly what I was thinking.

It's not like when Sainsbury priced up the Pizza Express pizzas incorrectly (pricing the large ones at the small price and vice versa). They allowed that one.

This is funny because i was talking about something similar in the car with my boss about an hour ago. I was bragging about how i paid a stupidly low amount for my Bond box set as every individual dvd was on offer for £2.50 at my work which i snapped up with my 10% discount meaning i had the entire set for £45 which at the time was a fooking bargain.

A tenner however is silly money!

Also geroge lazenby - my favourite bond.
