We talked about that on Saturday - I'd posit that Wise could argue for mitigating factors influencing his decision and therefore it was an action in response to unbearable provocation...and therefore not gross misconduct. But I'm no lawyer. I'd hazard a guess that Porter's situation is more clear cut, and therefore the action the club is taking seems pretty venal. When you have convicted murderers, thugs and thieves all plying a trade within the game at other clubs it makes you wonder - well, it makes me wonder anyways.

Hes never been seen smoking weed on the Saffy Lane park from what Ive heard... Ive been told the reason hes not playing, which I believe, and am not saying a word. Its nothing to do with Cannabis. He used to drive a nice silver Audi now hes on foot. Saw him yesterday morning and said Hello like he always does but he doesnt look a happy lad. I'm pretty sure he's banned from driving - Don't quote me on that though. Knowitall's in this thread, right now!

If I remember right, the problem with Wise was that we fined him two weeks wages after he hit Davidson and then terminated his contract citing gross misconduct. This was found by a tribunal to be punishing someone twice for the same offence and thus breaking employment law making it unfair dismissal. It didn't matter that he'd assaulted someone, and but for the grace of Leicester not calling the police, would probably have seen him charged. The fault was that they punished him with a two week fine, and then punished him again for the same offence in terminating his contract.

Im a bit of a softie anyway but I do feel, the club should just release him and let him try and start again elsewhere if they arent willing to forgive him/give him another chance. I dont see how keeping him here is helping the club or him. Thats my opinion anyway. I cant help but feel a bit sorry for the lad.
