The Blur Posted 18 June 2016 Posted 18 June 2016 I have googled over the last hour to find a answer but I can't find anything definitive and wondered if anyone could help on here I've been doing a job on a zero hour contract For nearly 12 months now (29th of June will be 12 months to the date) Been doing Mon- Fri and doing the same hours each week I found out today that they tried (unsuccessfully as other person didn't want the job) to replace me last week I just wondered if anybody knew how I stood with relation to employment rights as I seen reports that after 12 months I would be entitled to a full contract if regular hours was maintained during that period but others stating that that's not the case It might be worthwhile going to CAB for advice, your potential dismissal has not happened yet but it would be good getting information to cover your back if it happens (hopefully it will not).
Ross-Kemp Posted 18 June 2016 Posted 18 June 2016 It might be worthwhile going to CAB for advice, your potential dismissal has not happened yet but it would be good getting information to cover your back if it happens (hopefully it will not).Don't think they'd dismiss you, they just wouldn't renew your hours, apologies if you've already mentioned it, but surely just have a conversation with your boss?I don't understand the uproar about ZHC anyway, it's just the same as being an agency worker circa 5 years ago. At least now you know a week in advance if you've got hours, when I did agency work, I'd turn up at 0530 and on some days they'd say you're not needed and send me home.
SystonFox Posted 18 June 2016 Posted 18 June 2016 If I were on zero-hour contract, I would initially request what would my hours be and when - hence be up-front about it which would allow you to prioritise either this work and permanent job search thereafter. Hey wymesy I've got a job for you. It's on a zero hour contract. I'll pay you £10m per hour. The hours are never, the job description is non existnent. Sound cool?
z-layrex Posted 19 June 2016 Posted 19 June 2016 **** I hate these things. The worst company that I know for this are AMT (the coffee place). I was talking to a girl from Thailand who works in one at the hospital where I work, she has to do 8 nights in a row, if she refused they would just give all her shifts to someone else because there will always be another immigrant willing to work the hours. No annual leave, no sick pay, shit wages. It's like modern day slavery.

johnny the fox Posted 19 June 2016 Posted 19 June 2016 https://www.gov.uk/government/publications/zero-hours-contracts-guidance-for-employers/zero-hours-contracts-guidance-for-employers The guidance says it would be appropriate to employ permanent if their has been a regular pattern over 12 months. What is you do and how regular are your shifts? these things are a disgrace, they must be scrapped... without being too political I don't recall zero hour contracts being in operation until we had free movement from Europe..so much for protecting workers rights..
Buce Posted 19 June 2016 Posted 19 June 2016 Trying to read that made my eyes bleed That's because you have a turtle's head.

No annual leave, no sick pay, shit wages. It's like modern day slavery. On a zero hours contract they should still get pro-rated annual leave, statutory sick pay and at least minimum wage. Also there are still rest break entitlements and maximum 48 hour weeks unless opted out. Sounds like that company might be breaking the law in a few ways.
Rincewind Posted 19 June 2016 Posted 19 June 2016 Also if on ZHC you will be off the unemployment list and placed on the employed one. If you do not know your hours claiming for anything like HB can be a nightmare. Each time you work you have to reclaim and tell them the hours. Then it takes a couple of weeks for them to sort it out. If claiming JSA you still have to look for work even if doing ZHC and meet the signing on days rule If you know your hours and days then it is not really ZHC is it? If they need you permanent then you should be classed as a regular worker. With agency work you can call up before closing the day before and you can specify days when available when signing up. Still not keen on them either. I am sure Cameron has openly said he is a supporter of ZHC. He has said 'Some people like them' many times listing students in the list of one. Over the last few years the number of people on ZHC has increased. They are not meant or should be a regular job option. It may suit some students doing bar work but even then they agree on certain days and cover for others. It suits companies more than the workers because if they are a place that have varying busy times they do not have to pay people to stand around doing nothing so just call them in when needed without having to agree to the rights of a full time worker regarding short work days.
