From Wikipedia, the free encyclopedia

Sasha Montenegro (born Alexandra Asimovic Popovic in Yugoslavia, now Serbia and Montenegro) is a Mexican actress.

She moved as a child with her parents to Argentina, then relocated to Mexico. She became an actress in the 1970s and made several lucha libre movies, some of them with superstar El Santo. She also participated in four telenovelas, last one with a starring role (Una mujer marcada, "A tainted woman") in 1979. In the 1970s she maintained a relationship with then President of Mexico, José López Portillo y Pacheco who was still married. López Portillo obtained a divorce and then married Montenegro in 1995 and until his death in 2004. She had two children with him. In the last years of the ex-president Montenegro battled with López Portillo for access to him and his fortune. On several occasions she was limited visits to her husband in the hospital by his children from the previous marriage. López Portillo paid for legal counseling for his wife to ensure that she would be given what she deserved after his death. As of 2005 legal battles for his assets still continue.

Now we're learning! :D

John VI (in French this would be Jean VI but French accounting, influenced by the French view of the Breton War of Succession, makes him Jean V) (December 24, 1389 – August 29, 1442), known as the Wise, was duke of Brittany, count of Montfort, and titular earl of Richmond, from 1399 to his death. He was son of Duke John V (Jean IV) and Joanna of Navarre. John VI married Jeanne de Valois, princess of France, daughter of king Charles, the Mad and his wife Isabeau de Bavière. By her he had seven children:

Anne (1409 – aft. 1415)

Isabelle (1411 – 1442, Auray), married at Redon in 1430 Guy XIV, Count of Laval (d. 1486)

Marguerite (1412–1421)

Francis I, Duke of Brittany (1414–1450)

Catherine (1416 – aft. 1421)

Peter II, Duke of Brittany (1418–1457)

Gilles of Brittany (1420–1450), Lord of Prince

Unlike his father, John VI was a peaceful man, or so the end of the Breton War of Succession permitted him to be. He strove to reinforce ducal authority, by levying a permanent army and constructing a coherent method of taxation in Brittany. John VI was also a patron of the Arts and the Church and funded the construction of several cathedrals.

peaceful man, aren't all french people "peaceful" hence why they surrender at first given oppurtunity.

Alexander Scott Gonzalez

Alexander Scott Gonzalez (born April 8, 1973 in Miami, Florida) is a third baseman for the Philadelphia Phillies. He joined the league in 1993, spending 8 years with the Toronto Blue Jays before signing with the Chicago Cubs. After brief stints with the Montreal Expos and San Diego Padres, Alex signed with Tampa Bay Devil Rays last season as a third baseman, making the switch from shortstop.

He is not to be confused with Alex González, who is also a major league shortstop, currently with the Boston Red Sox after several years with the Florida Marlins.

"Gonzo" has a reputation for strong defensive play; however, in the 8th inning of Game 6 of the 2003 NLCS, he dropped a routine double-play ball that would have ended the inning with the score 3-1 in favor of the Cubs. Seven Marlins runs ensued and the Cubs lost the game and ultimately the series. This was shortly after a distracting incident in which a fan touched a foul ball into the stands which left fielder Moises Alou might have caught. Alou reacted with very visible frustration and anger after being unable to catch it, although there was no legal interference on the play. The batter eventually drew a base on balls, and it was Gonzalez's error that opened the floodgates.

The Cat-Toast Device is the never-ending source of energy that powers the Uncyclopedia (Also known as "The Buttered Cat Turbine").

The device is composed of two pure substances:

1) Cats - small mammals that always land on their feet.

2) Buttered Toast - tasty breakfast food that always lands butter-side down.

In 1977 A.C., Oscar Wilde, frustrated in his attempts to get two bisexual women back to his place at the same time, hit upon the idea of tying a piece of buttered toast to the back of a cat and dropping it from the top of a Leaning Tower of Pisa to see which would prevail. The cat-toast hybrid fell at the constant acceleration of gravity until it stopped just above the ground, hovering. Both substances wanted to hit the ground first, canceling each other out. Wilde was thus the first person to discover the principle of 'percatual motion', a particularly powerful form of perpetual motion, the process of extracting limitless energy from household pets.Oscar Wilde, always one to recognize the violation of laws of quantum mechanics, found a way to harness the limitless potential energy of the hovering cat-toast creation to power his Uncyclopedia. This discovery undermined any credit that Schroedinger's Cat Experiment had originally, which wasn't much to say the most. All rumors about the Uncyclopedia being powered by a Stormtroopers vs. Red Shirts Device or a Wind farm are totally baseless. This, of course, makes them absolutely true.

A Bathing Ape (with a line of apparel called Bape) is a Japanese clothing company that specializes in urban streetwear. It began in 1993 as a T-shirt brand and originated out of the Harajuku area of Shibuya in Tokyo becoming one of the very first Japanese streetwear brands to start in the early 1990s. Bape's logo and themes are all derived from the original Planet of the Apes movies. The brand's name is based on a common Japanese saying, "bathing in lukewarm water", that describes the willingness of Japan's youth to follow popular trends.

Prior to starting his label the creator Nigo worked for Boon. Boon is one of a number of mens magazines in Japan that focuses on street name brand fetishism.

Bape is known for its shrewd marketing, particularly the use of very limited production runs in order to stoke demand for its product. Bape stores are also usually hard to find and are not usually marked with signs to maintain exclusivity. Many stores have a one product per person policy to prevent any of the items from appearing on the black market. Bape has become so popular in Japan that it was commissioned to design a limited edition Pepsi bottle. Over the years, Bape has extended its brand from T-shirts (Baby Milo & Bathing Ape) to other apparel such as sneakers (Bape Sta, Manhunt), jeans and even underwear. A Bathing Ape has extended beyond clothing to a hair salon (Bape Cuts), gallery (Bape Gallery), cafe (Bape Cafe), record label (Ape Sounds) and (B)apeTV. A Bathing Ape also produces limited-edition hip hop-themed vinyl figures.

Although not as popular as the brand is in Japan, Bape has reached mainstream in the United States on account of popular entertainers wearing the brand, such as Pharrell Williams of hip hop production duo the Neptunes, the President of Def Jam Recordings, Jay-Z, Fall Out Boy and the rap-artist from Cash Money Records, Lil Wayne. Due to the success of the creative live, Pharrell has collaborated on a clothing and sneaker line with its designer. Bape's popularity in the United States was cemented when he opened the first American Bape store in New York City in 2004.

A Bathing Ape's success has earned Nigo, the creator of Bape, a Lamborghini, an Aston Martin, a Bentley Continental Mulliner Edition, a Ferrari 360 Modena and a home valued at $30 million in Tokyo's plushest area Roppongi Hills. He is also in collaboration with Pharrell on his clothing line called Billionaire Boys Club. Nigo has also designed Pharrell's shoe line Ice Cream in collaboration with Reebok.

More recently, Bape, through lack of availability and demand on online auction sites, has spawned a large number of counterfeit items or FAPE(s). With the shear numbers of Fape(sic) items produced there quality is becoming better and better and it is getting increasingly difficult to spot them. With the opening of a Busy Work Shop in LA toward ths end of 2006 exposure and counterfeit products could be at an all time high.

Offside is a rule used in association football (soccer) to ensure fair play and game continuation. The law is covered by Law 11 of the Laws of the Game, and only applies when a player is in the offside position and is involved in active play, or interfering with play. The offside position is determined if a player is closer to the opponent's goal line than the ball, and the second to last opposing player, which usually refers to if the player is in front of every opposing player except the goalkeeper. Despite its simple explanation, the application of the rule depends on several other factors of gameplay, and can be complex.

Rat excitation

There was no official designation for this procedure, thus the appellation "rat excitation," which was chosen so as not to conflict with the names of any extant articles. The prisoner was bound face upward to the rack, and an inverted lentiform drum of iron, filled with rats, was placed atop their belly. Next, a fire was kindled atop the drum, heating it and exciting the rats, which--in their frenzy--burrowed in the only available direction (flesh is softer than iron) and eventually bored all the way through the victim's abdomen, killing them.

A variation of this procedure was employed by George Orwell in his famous novel Nineteen Eighty-Four. The central character in the tale, Winston Smith, is arrested by the Ministry of Love and undergoes a process of mental reprogramming. When it is clear that this programming has been unsuccessful, the ministry imprison him in Room 101. Here Winston must face his greatest fear: rats. A cage filled with rats is placed over his head, their only source of food or escape being by eating their way through Winston's face. At this point Winston breaks and names his accomplice and lover.

Wristlock

A pronating wristlock used to hold a man's head down on a curb.A wristlock is a joint lock primarily affecting the wrist-joint and possibly the radioulnar joints through rotation of the hand. A wristlock is typically applied by grabbing the opponent's hand, and bending and/or twisting it. Wristlocks are very common in martial arts such as Aikido and Jujitsu where they are featured as self-defense techniques. They are also used as submission holds in combat sports such as Brazilian jiu-jitsu and Catch wrestling, while being an illegal technique in Judo[1] and Sambo[2] competition. Wristlocks are also used by law enforcement and military as pain compliance holds.

The wristlock is a technique that can be applied from a stand-up position, simply by grabbing the opponent's hand and twisting and/or bending it in a non-natural direction. It is considered to be a relatively safe technique to practice with a willing opponent[3], but if applied suddenly and/or forcefully, a wristlock can cause ligament tears or possibly even dislocation or bone fractures.

Legal system of Hong Kong

From Wikipedia, the free encyclopedia

Jump to: navigation, search

The legal system of Hong Kong is based on the rule of law and the independence of the Judiciary. The constitutional framework for the legal system is provided by the Basic Law. Under the principle of ‘one country, two systems’, the Hong Kong Special Administrative Region (HKSAR) legal system, which is different from that of Mainland China, is based on the common law, supplemented by local legislation. All ordinances in force in the HKSAR are accessible on the Internet at http://www.justice.gov.hk.

Law in the HKSAR

The laws in force in the HKSAR are:

* The Basic Law;

* National laws listed in Annex III to the Basic Law;

* The laws in force before July 1, 1997, that were adopted as laws of the HKSAR by the Standing Committee of the National People's Congress; and

* Laws enacted by the legislature of the HKSAR.

National laws relating to defence, foreign affairs and other matters outside the limits of the autonomy of the HKSAR may be applied locally by way of promulgation or legislation by the HKSAR. Currently, 11 national laws apply in the HKSAR.

[edit]

The Judiciary

It is fundamental to Hong Kong’s legal system that members of the judiciary are independent of the executive and legislative branches of government. The courts of justice in Hong Kong comprise the Court of Final Appeal, the High Court (which includes the Court of Appeal and the Court of First Instance), the District Court (which includes the Family Court), the Lands Tribunal, the Magistrates' Court (which include the Juvenile Court), the Coroner’s Court, the Labour Tribunal, the Small Claims Tribunal and the Obscene Articles Tribunal.

[edit]

Department of Justice

It consists of five professional divisions responsible for legal work. It is headed by the Secretary for Justice, who is a member of the Executive Council and is the Government’s chief legal adviser. He has ultimate responsibility for the prosecution of all offences in the HKSAR.

* The Legal Policy Division, as well as the Secretary for Justice’s Office, provides professional support to the Secretary for Justice in the execution of her duties and provides input on all legal policy issues being considered by the Government. The division advises on issues relating to the administration of justice, the legal system, the legal profession, human rights, the Basic Law and the law of Mainland China. The Law Reform Commission Secretariat, which provides research and secretarial support to the Commission, is within the division.

* The Civil Division provides legal advice to the Government on civil law, drafts commercial contracts and franchises and conducts civil litigation, arbitration and mediation on behalf of the Government.

* The Law Drafting Division is responsible for drafting all legislation, including subsidiary legislation, in Chinese and English, and assists in steering legislation through the Executive and Legislative Councils. It also has editorial responsibility for the Laws of Hong Kong and for maintaining an up-to-date version of those laws in the Bilingual Laws Information System, a computer database which is available free to the public on the Internet.

* Counsel of the Prosecutions Division conduct most criminal appeals up to and including the Court of Final Appeal. They also conduct the majority of trials in the Court of First Instance and the District Court and, when necessary, they prosecute in the Magistrates’ Court. The division also provides legal advice to law enforcement agencies and other government departments.

* The International Law Division advises the Government on issues relating to public international law. Lawyers in this division also participate in the negotiation of agreements with other jurisdictions and handle requests to and from the HKSAR for international legal co-operation.

[edit]

Law Reform Commission

The Law Reform Commission considers and reports on such topics as may be referred to it by the Secretary for Justice or the Chief Justice of the Court of Final Appeal of the HKSAR. Its membership includes academics, practising lawyers and prominent community members. The Commission has published reports covering subjects as diverse as commercial arbitration, data protection, divorce, sale of goods and supply of services, insolvency, fraud and statutory interpretation. The recommendations in many of its reports have been implemented, either in whole or in part. It is currently considering references on privacy, guardianship and custody, domicile, privity of contract, advance directives, hearsay in criminal proceedings and conditional fees.

[edit]

The Legal Profession

As at September 2003, the HKSAR had 840 practising barristers, 5 165 practising solicitors and 652 local law firms, plus some 33 foreign law firms, 627 registered foreign lawyers and six registered associations between foreign law firms and local law firms. Legal body governing the conduct of members is the Law Society of Hong Kong and the Hong Kong Bar Association.

[edit]

Legal Aid Department

The Director of Legal Aid is responsible for the administration of legal aid. Eligible persons are provided with legal representation depending on their financial circumstances.

[edit]

Legal Aid for Civil Cases

Legal aid is available for civil proceedings in the District Court, the Court of First Instance and the Court of Appeal (both part of the High Court), and the Court of Final Appeal. It also covers proceedings in some tribunals and certain Coroner’s Court cases. An applicant must satisfy both a ‘means test’ and a ‘merits test’. For the means test, a person whose total financial resources do not exceed $155,800 may be granted legal aid. The Director of Legal Aid may waive the upper financial limit in meritorious cases when a breach of the Hong Kong Bill of Rights or inconsistency with the International Covenant on Civil and Political Rights as applied to Hong Kong is an issue. For the merits test, the Director must be satisfied that an applicant has reasonable grounds for bringing or defending the civil proceedings to which the application relates. A person aggrieved by a decision of the Director may appeal to the Registrar of the High Court.

[edit]

Legal Aid for Criminal Cases

Legal aid is available for committal proceedings in the Magistrates’ Courts; cases tried in the District Court and the Court of First Instance of the High Court; and appeals from the Magistrates’ Courts, and to the Court of Appeal of the High Court or the Court of Final Appeal. An applicant must satisfy the means test criteria which are the same as for civil cases. Notwithstanding that an applicant’s financial resources exceed the statutory limit, the Director of Legal Aid may grant legal aid to the applicant if the Director is satisfied that it is desirable in the interests of justice to do so. However, in appeal cases, the Director of Legal Aid must be satisfied that there are meritorious grounds for appeal with a reasonable prospect of success. Notwithstanding the refusal of a legal aid application by the Director of Legal Aid, a judge may himself grant aid if the applicant has satisfied the means test. Applicants in cases involving a charge of murder, treason or piracy with violence may apply to a judge for granting of legal aid, and exemption from the means test and from payment of contribution.

[edit]

Supplementary Legal Aid Scheme

This scheme provides legal representation to the ‘sandwich class’ whose financial resources are above the upper eligibility limit for legal aid (i.e. $155,800) but do not exceed $432,900. It covers cases involving personal injury or death, as well as medical, dental or legal professional negligence, where the claim for damages is likely to exceed $60,000. The scheme also covers claims under the Employees’ Compensation Ordinance irrespective of the amount of the claim.

[edit]

The Duty Lawyer Service

Three programmes of legal assistance, jointly administered by the Law Society and Bar Association of Hong Kong, are subvented by the Government. The Duty Lawyer Scheme rosters barristers and solicitors in private practice to appear in the Magistrates and Juvenile Courts on a remunerated basis. The scheme provides representation to all juveniles (defendants under 16) and to most adult defendants charged in the Magistrates’ Courts who cannot afford private representation. The defendants are required to pay a handling charge of $300 upon granting of Duty Lawyer representation. In 2002, 45 162 defendants were assisted. The Legal Advice Scheme, staffed by over 840 volunteer lawyers, operates 10 sessions per week at nine evening centres. In 2002, 6 084 cases were handled. The scheme is not means tested. A free Tel-Law Service offers trilingual (Cantonese, Putonghua and English) taped information on 73 topics. Eight telephone lines operate 24 hours. In 2002, 51 058 calls were received.

[edit]

The Land Registry

The Land Registry administers the Land Registration Ordinance governing the system of land registration and provides facilities for search of the Land Register and related records by the public and government departments. It has responsibility for the registration of owners corporations under the Building Management Ordinance.

[edit]

Legal Advisory and Conveyancing Office (LACO)

LACO is part of the Lands Department. It provides legal advice primarily to the Lands Administration Office of the Lands Department and other government departments on land related matters and ordinances. LACO is responsible for drafting and settling government land disposal and lease modification documents. LACO is also responsible for the preparation of documentation relating to the acquisition of land from private owners pursuant to statutory powers and the payment of compensation to those owners. LACO administers the Lands Department Consent Scheme to approve applications by developers to sell flats in uncompleted developments. It also approves Deeds of Mutual Covenant requiring approval under land leases. LACO also provides conveyancing services to the Financial Secretary Incorporated for the extension of non-renewable leases, the Government Property Agency for the sale and purchase of government properties and the Secretary for Home Affairs Incorporated for the purchase of accommodation for welfare purposes in private developments. It handles applications for the apportionment of premium and government rents under the Government Rent and Premium (Apportionment) Ordinance. In addition, it is responsible for the recovery of arrears of government rents other than rents under the Government Rent (Assessment and Collection) Ordinance.

[edit]

Companies Registry

The Companies Registry is responsible for administering and enforcing the Companies Ordinance and several other related ordinances. Its primary functions include the incorporation of local companies; the registration of oversea companies; the registration of documents required to be submitted by registered companies; the deregistration of defunct, solvent private companies; the prosecution of companies and their officers for breaches of the various regulatory provisions of the Companies Ordinance; the provision of facilities to inspect and obtain company information; and advising the Government on policy and legislative issues regarding company law and related legislation, including the Overall Review of the Companies Ordinance.

[edit]

Official Receiver’s Office

When appointed by the court and creditors, the Official Receiver is responsible for the proper and orderly administration of the estates of insolvent companies ordered to be wound up by the court under the winding-up provisions of the Companies Ordinance and of individuals or partners declared bankrupt by the court under the Bankruptcy Ordinance.

It comments on draft intellectual property bills. It operates the registries of trade marks, patents and designs. It is also responsible for registration of copyright licensing bodies.

[edit]

International Co-operation

Under the Basic Law, the HKSAR has a high degree of autonomy in external affairs. With the authority of the Central People's Government where necessary, it has concluded more than a hundred bilateral agreements with other jurisdictions. In addition, over 200 multilateral international conventions are applicable to the HKSAR. Using the name “Hong Kong, Chinaâ€Â, the HKSAR also participates on its own as a full member in international organisations and conferences not limited to states, e.g. the World Trade Organization, the World Customs Organization, the Asia-Pacific Economic Cooperation, etc. As part of the delegation of the People’s Republic of China, representatives of the HKSAR Government participate in activities of the Hague Conference, as well as of other international organisations and conferences limited to states, such as the International Monetary Fund, the World Intellectual Property Organization and the International Civil Aviation Organization.
