davieG Posted 17 February 2009 Posted 17 February 2009 Source A former director of Leicester City has been awarded more than £2.24million by a High Court judge against a solicitor who deceived him over funding during a takeover bid. Gilbert Kinch, 65, of Kinchley Lane, Rothley, Leicestershire, was awarded damages against David Rosling, 70, of Hammerwood, East Grinstead, Sussex, who was struck off in 2006 for dishonest conduct. Mr Justice Tugendhat, sitting in London, who had been asked to assess the sum to be awarded against Mr Rosling, gave judgment in the sum of £2,243,240.86, inclusive of interest. The judge heard how Mr Kinch was "a respected and successful Leicestershire businessman" and had been a non-executive director of Leicester until he resigned in 1999. His QC, Jeremy Stuart-Smith, said the club was "one of his great delights and passions" and "in and from 2000" he attempted to take it over, believing that it was "not being well managed". At first he was a member of a consortium, but from the end of 2000 he went ahead on his own. Mr Stuart-Smith said that over a protracted period from late 2000 to 2002 Mr Kinch thought he was in negotiations with an organisation which agreed to make available the funds he would require. Mr Rosling, whose company was based in London, was the solicitor acting for the organisation. On the strength of his "representations and assurances" on the availabilty of funds Mr Kinch "committed himself to substantial expenditure". But the QC said that those representations and assurances were "utterly untrue" and the consequences for Mr Kinch were "catastrophic". He was unable to meet his debts as they fell due and his shareholding in the club became worthless, at a loss to him of nearly £1million. Mr Kinch was made bankrupt in 2003, suffering the "humiliation" which that brought. He has now been discharged from bankruptcy. Mr Stuart-Smith told the court: "Mr Kinch and his family have suffered intense humiliation, distress and anxiety as a consequence of Mr Rosling's deceit. "As a result of Mr Rosling's fraudulent conduct, Mr Kinch has gone from being a well-respected local businessman to a social pariah. "He has been forced to endure the indignity of personal bankruptcy and has had the constant threat hanging over him of repossession of his family home." After the ruling, Mr Kinch, who was present in court, declined to comment.

Going bankrupt must be a terrible feeling and the knowledge that you may lose your home has pushed many people over the edge, especially when someone has effectively "stolen" your money. Good Luck to Kinch, hopefully he invests the 2 million in his patented coffee pot radio business and lives a happy fruitfull life

We'll never know if the gang of four would have taken the club forward, MON got the clubs backing and removed all of the checks and balances at city then left within 6 month which led to the hiring of Taylor as manager by an incredibly weak board and our eventual drop into administration. Pierpoint and the gang of four did at least have a plan going forward, chucking more and more money at MON to try and get him to stay forever was never going to work.

Kinch 's ambition clearly outstripped his ability to pay for it or he wouldn't have needed to go to a bunch of dodgy financiers and get himself stitched up , Pierpoint always seemed like a chancer in any case and can't remember the other 2 off hand. MON handed the club over in good shape with a year's prem income and all the Heskey money unspent - Taylor wasted it all on signings like Akinbiyi and Jones plus paying more than he needed to Izzet and Elliott but he got us to the top of the premiership for the one and only time- then it all went wrong- that wasn't really the boards fault

Who would they have appointed when O'Neill left? At least Elsom and the plc built us a new stadium and gave all City fans a chance to watch the team on a regular basis.

They also misled fans about the financial issues at the club. But I still have no regrets about preferring them to the gang of four.

Who knows who would have got the managers job, couldn't have been a worse choice than giving Taylor carte blanche. Elsom and co bought a great new stadium on someone else's money which we are still paying back. You'd have to be an absolute idiot to think that what that board did was positive, we're still suffering for their total ineptitude.

renards Posted 20 February 2009 Posted 20 February 2009 Elsom was a fat slob who took the pisz out of hundreds of fans with his buses to Madrid, O Neil took his side during the take over debate, then fuccked off shortly after + shortly after saying Leic would have to sack him for him to go??!! O Neils gripe with Pierepoint was personal..not to do with the well being of the club The club was spending more than it was receiving + players living a being paid like film stars....Gay Bazza tried to control costs MON did'nt like it. Elsom proved to be a fat joke who moved on to the board of Grimsby and saying they were always his club! (+ it also helped him keep a role with the FA) The club went skint once and almost twice + Div 3 football Difficult to do worse
