Tevez dispute reaches High Court

Carlos Tevez's representative Kia Joorabchian has gone to court over the striker's move to Manchester United.

A High Court writ was served on West Ham's solicitors by lawyers acting on behalf of Joorabchian's companies MSI and Just Sports Inc.

The companies and Joorabchian claim they own the economic rights to the 23-year-old Argentine - though that is disputed by West Ham.

The £30m-rated Argentina forward wants to join Manchester United.

"I can confirm the companies have begun High Court proceedings against West Ham," said Teacher Stern Selby solicitor Graham Shear, the law firm representing MSI and Just Sports Inc.

The statement continued: "A High Court writ was served on the football club's solictors.

"The Companies seek the court's intervention to compel West Ham to release the registration of Carlos Tevez in accordance with contracts entered into between the parties.

"We are asking the court to intervene so that Tevez can be registered to play with Manchester United as soon as possible.

"We will be making no further statement at this time"

Earlier, Fifa recommended the Tevez dispute should go to the Court of Arbitration for Sport.

The Football Association and the Premier League had asked Fifa to rule on the matter.

But a Fifa statement read: "Fifa has recommended that West Ham and Carlos Tevez seek arbitration at CAS."

It continued: "Under the present circumstances this was deemed to be the best approach and in the interest of all parties.

"What is more, we also believe this to be the fastest way to solve this impasse."

If Carlos is still in limbo come 31 August, can we hope that he will honour his contract with us, at least until the transfer window re-opens?

CAS has yet to comment on whether it will hear the case.

United are expected to pay up to £30m for Tevez, but the transfer has reached an impasse over who should receive the fee.

Tevez is registered as a West Ham player, but Joorabchian claims he still owns the striker's economic rights and is therefore entitled to the transfer fee.

However, West Ham ripped up an agreement they had with Joorabchian - which broke Premier League rules - and they now claim any deal with United can only go ahead with their say-so.

The Premier League, which is also insisting that any fee must go to West Ham, met with Fifa and the Football Association on Monday to discuss the issue.

Fifa spokesman Andreas Herren said: "Under the circumstances it was felt it would be in the best interest of all parties to take this course.

"It looks like being the fastest way of resolving this matter.

"It is not a refusal by Fifa to get involved, quite the contrary. It is a recommendation by Fifa to opt for this way."

The Premier League welcomed Fifa's decision.

A spokesman said: "The Premier League and FA are grateful to Fifa for considering this issue.

"We are supportive of the recommendation that if all parties are in agreement the matter should be referred to the Court of Arbitration for Sport."

West Ham also said they were happy for CAS to rule on the issue.

"We're happy for the matter to go to CAS if it is with the agreement of all parties," a West Ham statement said.

As much as I'd rather nobody got anything out of it as they're all incredibly guilty, it does seem rather like Joorabchian has the right to it.

If West Ham are dumb enough to whore themselves by doing dodgy deals with agents just so they can sign a player like Tevez, then they shouldn't gain financially. If they do get the whole fee it will mean they cheated to get him in and he saved there season and saved them from relegation at an other clubs expense (imagine if it was us). To get a paltry fine and then earn millions on top in a transfer fee would simply be lunacy and would open the door on cheats prospering.

No doubt Sheffield Utd will want a slice and will mount yet another court action.

If the High Court determines that West Ham do not "own the economic rights" to Tevez, then The F.A. will be shown to have made a massive mistake in not relegating West Ham when this all blew up originally. In which case Sheffield Utd. should sue the backsides off of them.

Exactly. The money should go to whoever owns Tevez, which I think is going to turn out to be Joorabchian. If thats the case West Ham's TV money should be given to Sheffield United or something.

Give it to West Ham. Then fine them about £30mil for being ****s. Give that to lower league football.

Not a bad plan - only knowing the FA they'd give it to Ginger to sit at home and do nothing while they employed another dire manager for the national team.

You know... Man Utd will probably look at this in about a week and decide that Tevez really isn't worth 30mill and will withdraw the bid leaving Tevez at West Ham virtually hating them and Kia also rather pissed... that would be funny! :D
