Ched Evans found guilty

"Evans, of Ashtree Gardens, Millhouse Green, Penistone, South Yorkshire, and McDonald, of Marys Gate, Crewe, Cheshire, admit having sex with the woman but deny rape and say she was “in control of her actions” and consented to what took place."

Colour me confused but why does one go down for 5 years and the other get off?!

Sounds to me like the higher profile player was scapegoated while the other was let off! Also it says the women had "no recollection" of the events. Were the jury pissed when reaching their verdict?! Confusing! If Evans loses his appeal he'll still be out by the time he's 22 and will still have a good decade further in the game. Look at Lee Hughes for instance......

If hes found not guilty in his appeal and they sack him now, he'll probably be able to sue them for wrongful dissmissal (or something along those lines).

Sheff United have to walk a legal tightrope as well. Not saying they're correct, unfortunatly thats the way the world seems to work now.

Bit like when Wise tried to sue us for wrongful dissmissal just because of some legal loophole.

I'm sorry but there is no way that after being found guilty of a serious crime that a player can keep his job. It's not wrongful dissmissal he has been found guilty in a court of law and been sentenced to 5 years in prison for it. They are purely doing it for financial reasons because if he gets cleared on appeal they will have saved themselves a hell of a lot of money in transfer fees etc.

The moral of the story is if you are gonna go two's up on a rape make sure you're the fcuker that takes her back.....

Plus if you've got a mate outside trying to film it through the window, make sure he deletes all the footage. But I remember watching a Ched Evans interview once, he didn't strike me as the sharpest knife in the draw.

Appeal on the grounds of inconsistent verdict maybe? I'm no lawyer but I'm sure that's a very difficult ground to appeal?

As things stand he's a rapist and should be sacked I agree.

To be honest I really don't see a grounds for appeal in any of the evidence that has been made public, the only thing that could save him is if there was any problems during the trial that could potentially make him appeal on a mis-trial basis. Either that or appealing on the fact it was her word vs his but then again it states that he has been convicted because she was too drunk to consent, which is backed up by witnesses testifying that she fell over drunk in a takeaway and was bundled into a cab kissing Clayton McDonald (btw the "lady" involved doesn't come across as the angel she wanted to portray in my eyes")

He's 23. He'll probably be out by 26.

NO scapegoating, the jury heard ALL the evidence and came to a decision, it would not have been taken lightlly...

If he gets found not guilty in an appeal in a few months (unlikely I know) then Sheff United will lose a lot of money and he could probably sue them for some reason. It's just not worth it to them to risk it. Just suspend him without pay, wait to see if he appeals, if he does then just wait for the outcome and decide then.

I agree it's financial reasons, but I think in this situation every single club would do the same thing.

So as long as I'm seen walking into a room with a girl, I can have sex with her and it's not rape? But walking in afterwards, it is?! Like others have said, we ain't got a clue what really happened, but fck me, that's disgraceful.

The whole scenario is just sordid as anything. Awful stuff.

It seems she was with Clayton McDonald earlier in the night was seen in a takeaway with him they got into a cab and went off to his hotel room. Ched Evans came in claims they asked if he could join in and she said she doesn't remember them asking and would have said no, so Ched Evans goes down for rape of a woman "too intoxicated to consent".

Maybe she wanted McDonald to have sex with her, but not Evans.

It's probably not that simple though.

or drugged..the whole thing is sordid and shows a complete lack of respect for women...

Again it seems there's more to it than the media can currently report but it would seem that In McDonald's case the visit to the takeaway, the taxi ride and the kissing in the taxi could constitute reasonable belief for consent on his part. Once she was passed out whilst Evan's was with her, she had no say in the matter which would constitute no consent being given.

Wow, this case is a head ****, having sex with someone and not remembering is not rape and going back to someone's hotel room is not consent, even if she had said "lets go back to your hotel room and fvck", it is still not express consent and can be taken away at any point. If Evans did rape her, then McDonald let him and makes him just as guilty. I don't see how one could be guilty and not the other, and I don't see how she could prove either way if she can't remember anything.

I guess if there is video footage of it, it could be a case of she was clearly consenting to sex to McDonald, but was so out of it by the time Evans got involved that she couldn't have consented, but that would require video evidence, it also says that McDonald left the room after askin if Evans can get involved, but it is not clear if that is before or after Evans actually does anything.

I'm reading back through the other stories on the trial, this one makes it look very dodgy, but no mention of a video:

http://www.bbc.co.uk/news/uk-wales-north-east-wales-17757499

He tricked the hotel into giving him the key then let himself in to the room, it also says she was seen falling over at the bar, so evidence that she was very drunk.

Exactly as it was explained to me by my law student housemate, however he claims without knowing the full ins and outs he can't make a full judgement.....I called him a knowitall willy puller

Its as much her fault for being so drunk really.

That's no ****ing excuse you wouldn't be saying that if it was a female member of your family who was involved. That's ****ing bang out of order!

Apparantly he left by the fire exit after the deed which would not hsve helped him. Could well have shown that he had something to hide. At the end of the day there must have been some highly incriminating evidence for the jury to come back so quickly with a unanimous verdict.

He will have to live with the stigma of being a sex case for the rest of his life. Good.

On a side issue, isn't the odious Lee Hughes up for a sex assault soon. Perhaps they can share a cell on the nonces wing together. I wonder who will be the bitch?
