Never had to face this and I have no advice to give. I just want to say it's always sad when relationships end. I hope you both find a reasonable way through this and minimise the pain to each other.

She's not decided to remarry has she?  Could be the reason she is after a divorce and the money. You'd be effectively paying for her wedding if she is. Nasty thought.

Really think the law is an ass with divorce on things like this. Married for 8 months, separated for years and she thinks she has a claim to the pension you've paid into for years.

 

Works both ways of course, you should have no right to hers.

No idea. She just asked for my national insurance number so they can access my pension details & I said get your solicitor to write to me. She says that's another letter I'll have to pay for.

shes trying to play you off mate. don't give her any details until you get a letter from a solicitor outlining the reason for divorce. once you have this get a solicitor and talk to them. You will get some help here but you really need a proper legal team. If need be talk to them about the money situation and they will be able to help.

That is not how marriage is viewed by the courts though.

As soon as you get married you are agreeing to share everything for the rest of your life. If you or the other person then ends that marriage, the courts need to find a way to reflect that lifetime commitment in the settlement.

Exactly, hence "the law is an ass." If I ever get married I do not want the fear that if things ever went wrong, and there's a distinct possibility it could through no fau of my own if the spouse is the reason, that they potentially have the right to half of my pension.

 

It hasn't even crossed my mind that I'd want to plunder my other half's pension pot if we ever got divorced, especiall if there are no kids involved. It's grossly unfair in my view, no wonder more and more people aren't getting married, it's hardly a surprise when this kind of shit crops up.

 

And yes the above is doom mongering, you don't go into a marriage with view to a divorce but I can't get my head around people who don't plan for the possibility of it.

The law is an ass and 9 times out of 10 the woman come out off it smelling of roses and a lot better of then when they first met there husbands x
