I suppose if it makes a few footballers think about their behaviour in the future it's a good thing though.

From only quickly reading it, it seems McDonald brought her back to room, so i guess in some way they can say she voluntarily came back with him. But she never came back with Evans and doesn't remember him. (She probably never consented to either player but since she went back with McDonald it's harder to actually prove.) No legal expert and just guessing, could be totally wrong.

It's extremely bizarre and I don;t believe for one minute that goinf home with a man voluntarily clears you of sexually intercourse without consent.

I don't understand how his friend isn't some sort of accessory or accomplice but proving he raped her when she voluntarily went back to his hotel room alone with him would be a nightmare I'd imagine. Who knows, though? We weren't there and all we know is a few sentences in a short news story, the judge / jury will have heard far more.

Just there's probably CCTV footage or some evidence showing her walking back with him. She even says she can't remember how she got there. If it hadn't been recorded on a phone they'd probably both have got away with it. Just her drunk word versus theres. So hard to prove.

"The court heard that Mr McDonald met the woman and took her back to the hotel room, sending a text to Evans stating he had "got a bird"" and McDonald has not been charged. One assumes if he was deemed to have kidnapped the girl against her will he'd not be free?

Again, the court will have heard infinitely more than we have before passing it's judgement. We can speculate all we want but you start getting in to especially mirky water on the issue of sexual crimes, especially when alcohol or other substances are involved.
