Is the 'act' actually a crime or was it the fact he entered private property to commit the 'act'?

Having sex with animals is animal cruelty so it's an illegal act.

I think there are one or two states in the US where it is legal. James Whale on Talksport once had a guest on his show from the US who was in a loving relationship with a number of animals including an Alsation. 

 

There was some comedy gold on that show I can tell you. Wish I could remember some of the lines the dog molester came out with.

Although you'd assume that the horse would have either walked/ran away or kicked the bloke if it wasn't happy with what was going on lol

Not sure that would stand up in court.
