cisono Posted 12 November 2005 Posted 12 November 2005 Yeh i see that, but the point i tried to tell the officer was that i shouldent have been arrested or warned in the first place because i was the one who talked to the bouncer and said sorry for my mate shouting at him AND i spoke to this woman copper and told her i hadnt been drinking and im sorry for my mates argueing and causing trouble but coz they was drunk they really didnt know what they was gettin themselves into... and she agreed with me and was being well nice with me, but coz my mates didnt leave the city centre i got dragged into it and they arrested me when i shouldent have been warned off anyway Perhaps the moral of the story (in the eyes of the police) is that you would have been better off getting the hell out of town within 10 minutes of being warned, even if your drunk mates did not want to (and did not). Even better, avoid even hanging around with mates who: 1) get drunk 2) cannot handle their drink

A solicitor will argue your case for you, and advise you on what to say. I also think it will go for you, that you've taken the time and trouble to consult an expert in this field. Now someone's going to point out that it could also mean you are expecting to play the system, and look guilty, but ignore them Andy!
Alexikokopops Posted 13 November 2005 Posted 13 November 2005 Sounds like a bit of a shitty situation, and a bit harsh that you were told to get out in 10 minutes when you did feck all, although you were technically in the wrong when you didn't get out in time you should be able to argue you did fock all before hand.

And remember under the law you are basically only responsible for your own actions. That appears to mean that you are guilty of not leaving in the 10 minutes. This charge is easy to prove, whereas breach of the peace etc isn't so easy. I can't see you getting anything more than a fine though.

But i suppose i was guilty of what they charged me with anyway, i cant see it being more than a fine either, if it is id be very very very surprised.

I would deffo try to get a brief on the Legal Aid.
Head Honcho Posted 14 November 2005 Posted 14 November 2005 I was out last night and i saw buzzer b (paul hunter) and ashov coz they was in the same bar as i was in with my mates, one whos just turned 18 AND i saw you shum then later on this happened... Me and my mate hadnt even been drinking but about 8 of my other mates had n they was arguing loads with this bouncer so me n my mate tried to calm the bouncer n my mate down so the bouncer next thing ya know calls someone and the police are flying around the corner.. i was talking to this police woman and said i hadnt done owt wrong and she believed me coz she knew i was sober... And the police told us to leave the city centre within 10 minutes or we will arrest you.. so coz my mates was all pissed they was going LETS GO CREATION and me and my mate who was sober kept going dont do that they will see us and arrest us!!!! and my mates was pissed n didnt care so i told my mate "i bet you now the police follow us and arrest us" 2 minutes later big riot van and loadsa police cars pull up... got my mate who was with me who didnt do anything wrong got him handcuffed and he was like i aint done anything what u doing so i shouted DONT ARGUE WITH HIM COZ ULL MAKE IT WORSE!! so the policeman ran over to me grabbed me n dragged me over against the wall... and i was like what u doing and he goes ur all under arrest n all this so he chucked bout 8 of us in this big police van and took us to the police station and i was in a cell on me own for bout hour n half i was well upset n mad coz i didnt even do anything wrong, i was trying to calm things down and get my mates away to go home and get out of trouble and i was completely sober. Now ive got to go court on wednesday for something i'm not guilty to. <_< A good lawyer will get you off this charge in minutes. Unless of course the Police in Leicester have been given special powers that allows them to order a person or persons out of the city centre. This is a total breach of your Human Rights and if i was you i would fight it. Many reasons why you should fight it, not least because you would get yourself a criminal record and you would also have to declare it on many Job applications until spent in 3-5 years time. You might only be looking at a fine but that doesn't matter the fact that you will have been convicted of an offence is what you should worry about. I have been in a similar situation to you and decided to fight the charges against me, I pleaded not guilty and the case was adjouned, i got a letter through the post a week before I was due back up saying that the charges had been dropped through lack of evidence. My Brief assured me that this was because pleaded Not Guilty Had I pleaded guilty at the original hearing i would have been convicted. What happens you see is that the police do not have to show up for the first hearing and all they're evidence is read out by the prosecution. As soon as the police have to show up for hearings it gets a bit costly so the CPS look at the charge again to see if a conviction is worth the time and money. Whatever you decide to do Good Luck but make sure you don't let them tuck you up for something so bloody stupid.
