But what about the parent's rights of not having to sit in the car with their kid smoking!!!!!!!

How is it going to be enforced? I am not against it. Any sensible parent would not do it anyway. Maybe parenting skills should be taught and save the money and time police spend on prosecuting. The police force are stretched as it is with cuts being made.

If you are stupid enough to be seen doing it then you will be reported and then issued with a fine.

Ah yes, the classic "I let my child smoke even though he's under the legal age to do so" defence. I reckon that'll work a treat with the police :D

What about E-Cigarettes?

Rules about smoking in private vehicles

Private vehicles must now be smokefree if they are enclosed, there is more than one person present and one of them is under 18.

So it is an offence:

  • for a person of any age to smoke in a private vehicle that is carrying someone who is under 18
  • for a driver (including a provisional driver) not to stop someone smoking in these circumstances

The rules don’t apply to e-cigarettes (vaping).

Some might get away with it if they fully-open their vehicle windows for a few minutes whilst smoking.

Obviously the law makes sense if they smoke and don't have any window open!

The same way mobile phone use is enforced by sheer luck.

I know that. Good luck to them spotting who is holding a fag as it speeds by a camera. I just think mobile phones are easier to spot. Is it just the driver that is  not allowed to smoke? I was just thinking a fag can easily be passed over then it will take  time and money to prove it.

I think for many the fact that there is legislation will finally be enough to stop them if they haven't already along with the health messages as it raises even more awareness of the dangers to children. To continue will be a completely selfish act with ignorance being no defence. Similar to mobile phones, booster seats and seat belts years ago it helps to get the message across once it becomes law.

I thought you had to be 18 to buy them but 16 to smoke legally?

 

i always thought this too. we used to have bifter breaks in sixth form (aged 16-18) where teachers an students would all go and smoke together happily. surely if it was illegal that would not be sound.
