Anyone got any advice on what to do? Cough up? Appeal? Ignore? I've been told all sorts of stuff by friends and family.

There has never been a psucessful private prosecution made in this country for car parking. They have to prove several things. If you don't communicate. Ever. They can't do that.

Ignore everything, the letters will get more threatening and they'll ring your phone etc. but eventually they'll just stop.

Frank to be Posted 24 July 2015 Posted 24 July 2015 I wouldn't ignore them if they've got your address. If you want to appeal you've got to do it within certain time frames. If you don't do anything they'll keep coming back at you for larger and larger sums of money and you have to consider whether it's worth the hassle when it sounds as though it was actually a fair ticket.

There's also Pepipoo forums if you Google them. Essentially it's as enforceable as someone parking on your drive and you going outside and sticking a piece of paper on their windscreen saying they owe you money. Ignore it. Their business model is hoping about 50% pay through fear and that's enough money it's not worth chasing those that don't pay as going to court is too expensive and if they win they can only claim whatever losses they incurred (ie. None, or much less than the £60 asking for)

Nick Posted 24 July 2015 Posted 24 July 2015 What do they have to prove? 1. Who was driving - they can't do that if you don't communicate. 2. That the signage was enough to allow the subject sufficient information and that you then entered into a binding contract, in relation to parking. (Such legal contracts require an opportunity to reflect/consider the decision and they can't prove that you entered in to the 'agreement' knowingly having seen and understood all of the signage and the terms of the agreement.) The letters will get redder, the photo's bigger, the type bolder, the lettering in capitals and the fine greater. They rely on fear to operate as they don't legally have a cats chance in hell of prosecution in court.
DANGEROUS TIGER Posted 24 July 2015 Posted 24 July 2015 The private enforcers to not have the power of the police, or council enforcement officers. So assuming it was private property, my advice is to advise them that you will contest the matter in court, as you were not the driver. That's how I would approach it. Hopefully you wont try parking there again.
BoyJones Posted 24 July 2015 Posted 24 July 2015 It's a civil matter, the car owner cannot be procecuted. Only the driver can be found liable. If the parking company don't know who was driving the claim is unenforcable. My son parked my wife's car by mistake in Luton, and the car park company came after my missus really forcefully. I had to reluctantly get involved and accused them in writing and threatened to take them to court for trying to obtain money from my wife under false pretences, basically extortion. Got a one line reply saying the penalty notice had been cancelled. The parking company have no right to to ask you who was driving as you have no contract with them. Meant to say ignore all correspondence, but they sometimes get hold of your mobile number.

DB11 Posted 9 September 2015 Posted 9 September 2015 The only experience I've had with parking fines was that I was issued one in Morrisons car park, did some research and came to the conclusion that it's not enforceable and their business model is that as long as 50% of people pay the 'fine' (invoice) through fear then they make enough money so it's not worth chasing the rest for it, so I ignored the letters and nothing came of it. IF they take you to court, then they can only claim what they've lost, which is going to be significantly less than their charge and so as long as you pay it and don't ignore the courts you'll be fine. This thread is someone having an experience receiving a parking ticket from the council. I'm not disregarding your advice, merely trying to understand... A lot of people from what I've seen are saying that the PCN is the legal document, the photo is only supporting evidence that is not even required from a legal point of view. The PCN cannot be re-issued for the same offence and as such, is invalid if the reg. number on the document is incorrect. And that essentially, the wrong information will be sent to the DVLA by the council and the wrong (and unlucky) car owner will be contacted should I choose to ignore. Is this not the case? Edit: I've just seen this article on Which? It states "If key details such as the registration number are recorded incorrectly, the parking ticket is invalid." Still interested in points of view though...
AndWhat? Posted 10 September 2015 Posted 10 September 2015 I got one from poplar services when we played Burnley in the Championship season and just ignored it. They sent letters threatening court action and some other shit but I just carried on ignoring it and haven't heard from them in over a year. Pretty sure that's the way to go about it! Another trick I heard was to send them a cheque for a fiver and a letter saying please accept this as full and final settlement, then if they cash it they are agreeing to it being the final amount. Not sure if that would work though.
