We'll be right in the thick of a lot of this, both for and against. We'll have some sort of case against Man City I'd imagine.

 

Just looking at the Championship 2023/24 - teams who could argue they missed out as a result from us. Ironically those who finished 3rd (Leeds) and 7th (Hull) are now both in the Premier League.

 

But bring on the joy of this though. A load more legal drear and Stefan Borson's name appearing everywhere every day. Joy.

This is the issue now, it's always someone else's fault. People never seem to look at their performance first.

Burnley were able to go after Everton because Everton's six-point deduction, had it been applied in the season they breached, would have resulted in Everton going down and Burnley staying up. If our six point deduction for the 2023/24 breach been imposed during that season, we'd still have finished in second, a point ahead of Leeds. So a completely different case to Burnley/Everton.

It's an impossible argument to make IMO.

 

If the points deduction is applied during the season then do Leeds only get 4 points from their final 6 games? To me they imploded because they couldn't keep up and it all got too much. Alternatively, do we beat WBA and then thump Southampton and PNE if it's still as tight as it was?

 

The pressure was lifted for us and it wouldn't have been if we were 1 point clear.

Maguire claiming sides could go after Chelsea after they were found in breach but didn't get a points punishment.

 

Was their breach during the season they finished 4th and we finished 5th so missed out on Champions League? 

 

Everton upset the neutrals last season - got the draw vs Man City to derail their title charge and lost to Spurs to help them stay up - so not many fans will have sympathy with them!

Sure, but Burnley's legal argument hinged on the fact that Everton's deduction would have relegated them and kept Burnley up. There's no ambiguity there—it's just a matter of fact. The same would not apply in our case as our deduction in itself would not have denied us promotion. Leeds' argument could only be that they'd have got more points if we'd have been punished earlier, which is highly subjective and impossible to prove.

I'm not sure if agree with this. Everton were punished their breaches. It's not their fault that it took so long and the punishment happened the season after. 

If this is going to be the norm then the punishment for PSR breaches NEED to be happening in the same season as the transgression.

So by my reckoning if Man City hadn't have cheated and Chelsea hadn't have cheated, we'd have won the World Cup by now.  And Ayew would have won a golden boot.  Courts in session.

How could a points deduction have been administered in 21/22 as Everton technically hadn't breached during the season when the accounting period is through to June?

I'm not sure if agree with this. Everton were punished their breaches. It's not their fault that it took so long and the punishment happened the season after. 

If this is going to be the norm then the punishment for PSR breaches NEED to be happening in the same season as the transgression.

The potential repercussions of this are berserk.
 

Man City and Chelsea cost us 2 CL spots. It’s inconceivable we’d be in the situation we are now if it wasn’t for that.

 

You then get into a causation debate, should Leeds sue Man City because our breach that may have affected them was down to Man City breaking the rules.
