There were signs on the walls saying a new parking scheme had been introduced and I, because it had never been there previously, took no notice. I got stung with a ticket on my window and a fine. I contacted the Council and they said it was a private arrangement set up by the pub to stop people parking there and shopping in Blaby. They said that many people had got similar fines. They advised me to pay the fine, which I did. That is exactly the same cart park my Dad got stung at!! he appealled and didn't have to pay, its swings and roundabouts though... The pub owner was an inconsiderate arsehole about it though
Callabinho Posted 4 September 2012 Posted 4 September 2012 This has happened to a friend of mine before, unless they have permission off the government, they can't issue parking fines, they would have had to fine everybody within the vicinity if so, as mentioned they won't take you to court as it will cost them, plus if more people have parked there without receiving fines it proves that it's not official, it would look highly suspicious fining a large group of cars! You could always contact citizens advice if you are worried?

Even the police cannot fine you, just charge you a fee for not taking you to court. As other guys have said, Ive had sooo many from Morrisons, just ignore the fat bald criminals and their sad print-outs soon stop. As I mentioned in my last gears post, this country needs to stop letting people who look like eggs in high vis jackets telling everyone what to do.

Yes We're they obviously located?..... Yes Was there CCTV?....... Yes Was it clear what the amount of fine would be if I parked there.. Yes What I asked them: Was it a bona fide private firm,... Yes Had other prople contacted the Council... Yes Basically they advised me I would most probably lose if the case went to Court and, in their opinion, pay the 60.00 they were demanding. This would have increased to more if not paid within 14 days, i think, which the Council also said they were in their right to do. All depends if you want to pay up and get it done. Or Fight it and live with what comes... Weighing up the professional advice I had, I went for the former. Expensive trip to the bookies that was... The Don Posted 5 September 2012 Posted 5 September 2012 Debt recovery companies have no real power, for instance they can't kick your door down and enter your house like court appointed bailiffs can. All they can do is enter through open doors and windows. They take a list of your property and have to take you to court for it. As long as they don't get a look inside your house to take a list of what saleable property you have they can't do anything. Unfortunately, as you have been billed for parking, they know you have a car and can take you to court for the car to recover their money. You can take the risk of not paying if you wish to because sometimes it is just an empty threat and they drop it instead of passing it on to a debt recovery agency. Bear in mind though that unpaid debts can affect your credit rating This is totally wrong, please do not post such drivel as this may unduly worry some people. Debt recovery agencies cannot go through open doors or windows, if they do, call the police as they are trespassing. Bailiffs cannot enter your property by force unless they have been in there before, and they can only enter the property peacefully the 1st time. I could go on, if anyone is worried then research this on the internet. I would suggest not relying on the citizens advice bureau totally as in my experience, they gave incorrect advice - by actually telling me to pay something that I was not legally due to. dynamark Posted 5 September 2012 Posted 5 September 2012 Mitch Word in your ear mate - Youll need more than a good credit rating to get a loan from a bank.If you have an assett they can take a legal charge over you may get the loan regardless of any other minor issues.Good luck though

About four years ago, I was called private site, to try and resolve an argument between between a clamper on the driver, who refused to leave his vehicle. His car was lifted onto a truck, with him still in it, a disappeared down the road!

If you had refused a police parking ticket you would end up in court, where you would be 95% likely to lose, and then pay costs also. Parking tickets issued by council attendants that are challenged by a the motorist will normally go to an independent tribunal. I think you are either remarkably lucky, or telling porkies.

Vardinhio Posted 9 September 2012 Posted 9 September 2012 Dealing with contracts day in day out I have a decent grasp on this... Basically when you park in their car park you can enter in to a contract with their terms and conditions on the basis of intent alone (ie you leave your car there). However, to be legally enforced the "reasonableness" would be considered. So, for example are the signs correctly displayed etc? In essence you would probably be refusing to pay on the basis that you were unaware of entering such a contract as to be valid a contract needs a "meeting of the minds". You should be stating that you DID NOT enter a contract. However, the above is all irrelevant. The main point here is simply that in reality no company is going to put the time/effort/resources to chase you through a court for £100. Ignore the letter and if you really have to respond go back to the car park and check for flaws in their administration/signage etc.

I receive a number of tickets over the course of the season and never reply to any. Needless to say, after a few notices through the post from various debt collecting agencys they all disappear. I just found it amusing that when my friend told then he would see them in court they canceled so quickly. However by contacting them, like you say, it becomes even harder to get rid of them, my friend was lucky as you dont usually get rid of them that easily. Also private parking companies can't ccj you our send bailiffs round. As I said earlier in this thread these charges are nothing more than a speculative invoice relying on a percentage paying out of fear.
Ric Flair Posted 10 September 2012 Posted 10 September 2012 Have you got an irritating mother-in-law or even partner who you'd like to tuck up? If so, contact them and tell them that it was them who was driving and they took your car without consent. Tell them you'd be eternally grateful if they could get them put away for it too.
