How can you be independent if you are the one who has allegedly been hit? and it doesnt matter if they were involved or not. They are still perfectly good witnesses. and your implications that they need to be independent and uninvolved in order for it to be a secure prosecution ( its there words against his) is what makes it look like you are saying they are less likely to give an honest and accurate account ( and therefore less credible! because they were involved) it may well end up being there word against his ( highly unlikely in the middle of town with presumeabley at least a few others out drinking!). But that still good grounds for prosecution. That's the point I'm making they can't be independent because they are by definition not witnesses they are involved. Therefore I'm saying that in the circumstances of no independent witness their evidence is no more or less credible than Mattocks. So if they say he did something and he says he didn't who do you believe? Hence the need for independent witnesses to corroborate one or the others evidence. Anyway this is all academic as I can't believe there will be no witnesses - But just to reiterate I'm not doubting their or Mattocks credibility because I don't know them or the circumstances of the incident.

The guy turned his back on LCFC yet you still try to defend the scroat. Turning yourself in, or 'helping the police with their enquiries' can be a smart move, and certainly doesn't mean that you are guilty. In fact, it looks very good in your defence, as you have co-operated. The fact it was over 24hrs afterwards can be very easily explained. Seeing as we don't have all of the facts, everything so far is speculation. Sadly a very small percentage of rapists do go to jail... I dont know the up to date or exact figures but I know its a very low rate of alleged rapists that get convicted and I dont believe theres that many "victims" that make it up Its a hard one to prove I guess... anyway sorry for straying off topic It's a very difficult charge to prove. I've been sitting in a few cases of this nature recently, and as an observer, it's a hard call to make, so to be a juror having to make that decision isn't something I would want to do.
