Guest Basildon Fox Posted 30 October 2015 Posted 30 October 2015 How long does it take to start legal proceedings. Sounds like the usual hurt someone suffers when they lose their job? All bravado, no substance and without a leg to stand on. Does anyone really think that if he had been so harshly treated that Walsh and Shakey, his 2 trusted assistants, would still be here?
Guest MattP Posted 30 October 2015 Posted 30 October 2015 Course they would, do you really think they'd resign on principle and throw away the presumably exceptional contracts they have?
ImBlue Posted 30 October 2015 Posted 30 October 2015 probably starting legal proceedings after realising his next job will be back in the championship.
Wymsey Posted 30 October 2015 Posted 30 October 2015 Perhaps Pearson is taking a sabbatical (some managers have a break for up to a year) and will pursue his case against the club when he's ready.
Guest Basildon Fox Posted 30 October 2015 Posted 30 October 2015 Course they would, do you really think they'd resign on principle and throw away the presumably exceptional contracts they have? Yes. It is also usual for staff to leave when the manager goes, see Villa and Liverpool for most recent examples, yet they are still there and still seem to have influence. Haven't seen any discontent from the players which is unusual too. Anybody losing their job nearly always feel cheated and victimised but only very rarely have a case on unfair dismissal. I have been let go a couple of times when I was younger and felt hard done by but that does not mean that from a company point of view they were wrong.

Most managers leave when the team is doing sh1t but this was not the case here so of course they will stay, and LCFC and CR would want them to stay, to keep the continuity going and reduce the unsettling effect on the players. However, when NP finds a new job they will almost certainly follow him imo. Why ? Easy. Because they work as a team and in that lies their strength. Apart from the fact that they are probably very loyal to each other it makes financial sense to stick together. What if when NP asks them to join him they don't ..... what they have built together and been successful at will be lost forever. If they stay here and CR then decides to move them out when his new boys get up to speed (possible), what do they do then ? (Financial suicide) ... NP will certainly tell them to b*llocks. No, that would be foolish and too risky. And when NP is negotiating for the new job (and the new team if they ask him to join them will presumably want him at all costs), will ensure that their salary, AT LEAST, matches what they are on now. Otherwise he says no. All of us or none of us. So, assuming that what does LCFC do ? Keep an eye on them and make sure they are doing what we pay them for ... not scouting and holding back for when they move. (Perhaps send the shadow team out with Walshy) ... offer a big bonus for anyone found who plays a certain number of games if they (Walshy or Shakey) stay or go ..... check they do not spread unrest. And, perhaps if CR really wants them to stay ... a BIG pay rise and long term contract that will make it harder for NP to persuade his new masters to take them on. The cynical world of business I'm afraid.

GingerrrFox Posted 30 October 2015 Posted 30 October 2015 Yes. Haven't seen any discontent from the players which is unusual too. Liverpool and Villa is different as all staff not wanted had their contracts terminated by the club. Do you really think Sean O'Driscoll for example resigned?

The cynical world of business I'm afraid. I'm pretty sure being involved at a successful premier league club is going to help their careers more than following Pearson back to the championship. You're also making no end of assumptions about what people you don't know will do in different situations. Most likely scenario in my opinion is that shakey and Walsh choose the successful premier league club rather than the struggling championship club that Pearson will likely find himself at. And even if they do choose the big step down, I think that would just show that their ambition doesn't match that of the club and them leaving will probably be for the best anyway.

The cynical world of business I'm afraid. A good post. As we don't know full details of NP's dismissal, it is impossible for us on the outside to know if NP has grounds for unfair dismissal. From what I know about employment law, I would think his son James does have a case, because of the Vardy incident, and if NP is thinking of a claim, this could be used in retrospect as further evidence his son was sacked unfairly, enhancing his own claim that he was dismissed unfairly (if this was the actual reason). You can't sack one person for an alleged racist taunt, and then give a different punishment to another person who does a similar thing. The Hopper/Smith/Pearson video was well documented and shown all over Thailand and from what I saw here, James Pearson didn't say anything in that video, but it was clear Vardy did say things in his casino rant. If NP disagreed so much with the owners about his son's sacking, he may be able to now use the Vardy incident, in retrospect, to prove the owners acted unfairly. Time will tell, but I doubt we'll ever hear the complete truth.

People need to get over Pearson. He's gone, and Ranieri is a far superior manager. Things don't get much better than they are now for Leicester fans, try to enjoy it.

Whilst i would agree with most of this post, it could be argued that Walshy and friend might be very aware that Nigel has chosen to sit on his arse at home still thinking about suing the club instead of taking employment elsewhere ( therefore breaking his contract, thus nulifying it and releasing him from his gardening leave). They might be thinking " just how long does he expect us to wait before we move on from him and sink our teeth into the Ranieri Bandwagon.?"

Guest Basildon Fox Posted 30 October 2015 Posted 30 October 2015 Another thing that I would question is the fact that the Thais could no longer have a working relationship with NP but still have no problem employing his 2 old assistants.

They might be thinking " just how long does he expect us to wait before we move on from him and sink our teeth into the Ranieri Bandwagon.?" It will happen because of the reasons that I have highlighted (imo) and the timing is not important because they are in paid employment and the bills are being paid. it is a slightly false situation but at the moment it suits us for them to stay and suits them as well. Don't be lulled in because they are still here. Everyone is being very professional but everyday they come to work they sit down next to their replacements ... put yourself in that position .... what would you read into it. To be honest there are other factors that might come into play here but I didn't want to over complicate things ...... what if Shakey and Walshy have a real problem with why NP left and are upset with the stance he took over his son .... big fall out ??? We'll just have to wait and see, but, if I was a betting man ... I'd say they will be off.

People need to get over Pearson. He's gone, and Ranieri is a far superior manager. Things don't get much better than they are now for Leicester fans, try to enjoy it. Firstly, I'm not supporting Pearson, or his son, here, just pointing out employment law. A gross misconduct charge would be applicable anywhere as he was representing his employer. He would have been sacked for gross misconduct. If you go away on company business and then film yourself shagging a local brass then you deserve all you get. I very much doubt that anyone would advise them to go to a tribunal over it. Totally agree. However, it was the comments made by Hopper that were racist and really did the damage by hitting the headlines. Pearson didn't say anything on the videos shown out here in Thailand. Vardy was not at the Casino representing the club unlike Pearson junior. You are right he was on his own and not on an official tour, but as such a high profile player, he was still representing the club. All the articles I read named Vardy as 'a Leicester City player'. Just go on google and put in 'Vardy casino' and you'll see every article states this. Putting it another way, if you employ someone and they are filmed shop lifting out of your working hours, it still reflects on your company as much as it does them. There are endless examples of this in all work places.
Guest Basildon Fox Posted 30 October 2015 Posted 30 October 2015 Why? What's wrong with that?Nothing. The point I was trying to make is if it were purely football reasons why NP went then his team would realistically gone with him. If he had been harshly treated then they would have gone with him in protest. No rumblings of discontent from them or the team. Nothing from Nugent or Konchesky now they no longer play for us. It seem to me that the Thais had valid reasons for NP going. If he was sacked unfairly then surely by now he would have taken them to a tribunal.

A gross misconduct charge would be applicable anywhere as he was representing his employer. He would have been sacked for gross misconduct. I don't fully understand this response. You said that Pearson Jr might have a chance at proving unfair dismissal. I said they broke laws, not the racism, but other laws and that leaves him without a leg to stand on. If you go around breaking laws on a club tour and get sacked for it you haven't got a hope in hell of claiming for unfair dismissal.
