Theres a difference between 2 pints and 10 pints, yet if you're unlucky on 2 pints, then your still classed as a drink driver- and tagged as one as well-as seen by the reaction here before the bloke told us how much he'd drank. They should just cut the limit to 0mg, then stick a breathalyser in every car, which activates the ignition once you've blown in to it. As for the OP, you will not go to jail. Get a lawyer if it makes you feel better, but will lose your license for sure. I reckon all told, your looking at an 18 month ban, and a 300+ fine. Doubt you'll get community service. i thought it was 55mg.

Should throw the book at you, as something like that you just cant excuse. Want your brains testing. Just count yourself fortunate that you didnt hurt anyone in the process, could have been far far worse.

I know enough people who have 2 or 3 and are completely fine and literally no risk, yet the day they get caught they're done for. Whilst I've never touched it whilst at the wheel, a night out ending at 4am and a 9am drive is hardly uncommon for me, often wonder if I'm running the risk then. You definitely are

What punishment am i looking at, shitting it I know for a fact that you will now feel like an absolute dick now and you don't need to read what people on here are saying to know it (though they are absolutely right). The thing is, if it was something like speeding or even just having half a pint then I personally could feel some degree of sympathy for the situation you find yourself in. However, having 2 and driving is pretty damn stupid. Also, I'd argue that having your phone in your hand is possibly even more stupid to be honest. I hate seeing people on the phone while their on the road, for me it is even more of a risk. If your using your phone, your not paying full attention. it is extreemly careless and you are putting other people at risk.. Driving without a seatbelt on only really risks you putting yourself at harm so thats your choice (although if you've been caught by the police, it just means you'll get even more of a bollocking), The thing is, if you have drunk and driven (and used your mobile while driving) this time , the chances are you've done it plenty of times before and will probably do it again in the future, so something had to stop you before you hope someone. Maybe it would've been a good thing if you were given a real warning of some sort beforehand to stop you doing this. For example, if you were caught on 30mg then you may have thought "Shit that was too close for comfort, I won't have any from now on!", just to really make the penny drop so you sorted it out. Just out of interest did they take a second reading? Because I'm pretty sure they need to breathalise you at the police station for proof. Good luck either way, I'm sure you've learned your lesson by now!

The reason he'll have been charged is due to the result of the lowest of two readings given at the Police station. He'll be looking at a ban between 12 - 16 months and a fine, probably 12 months if he's pleading guilty at the first opportunity. And a reading of 54 is not two pints, unless they're bloody strong! i thought it was 55mg. It's 35mg, but they tend to waive most under 40.

Even if the combination of both of those delay your reactions by just half a second. . travelling at 40mph means your delayed reactions would mean you are 25 ft further down the road than you would be if you were not using your mobile or hadnt been drinking. Travelling at 50mph would make you 37 ft further down the road and 60mph would make it at least 43 ft further down the road at the point of stopping due to the delayed reactions Thats plenty enough to kill someone. whilst im sure the OP has heard that plenty, he needs to think just how devestated his own parents would be at losing their son at such a young age.... Blueblood88 im really hoping has learnt his lesson and should be thankful he did it without ending someones life.. Surely whatever punishment he gets would be much easier to cope with than knowing he ended someones life by his actions...

To start with, I am not condoning drink driving under any circumstances and am not 'defending' the OP. Let's say that he'd had 2 pints with his mate in the local in the next village. When he leaves it's late, he only has to drive 2 miles home, on his own, on a road where he probably won't even meet another car. I know he was committing other offences as well but Is it really fair to call him a cvnt for the above? How is this worse than doing 20mph over the speed limit? Is it worse than doing 20 over the limit while using a phone? What about speeding/using a mobile when you have passengers in the car? I could go on with this. I know drink driving is taboo but I'm not sure why it's more so than speeding or other dangerous offences. I'd be interested to see the accident rates of drink driving compared to other offences.

Nick Posted 6 May 2011 Posted 6 May 2011 I think a bench will look at this as follows: Hefty warning about potential dangers to yourself, wider public and a further warning of custody should it happen again. Expect to lose your licence for a year - I doubt they will ask you to re-take your driving test. Expect 6-9 points. Expect a fine - I would estimate between £100 -300 You depending on the area you live may be instructed to go on a driving course and/or do 'Unpaid Work' - (Community Service) for around 60-150 hours. Get a very good solicitor - make sure they can talk to you about sentencing, knowing all the outcomes and with a proposal - not of mitigation but of how you know how reckless you were and show remorse to the court and paint you in a good light. Keep eye contact with the bench when you talk and when they speak. If you get the opportunity to speak in Court - do so. Explain what a fool you were, show understanding for what may have happened - assure them you will not make such poor decisions again. Dress appropriately - don't look like every other disabled that wanders in and sticks two fingers up to the Court. Offer to pay any fine and undertake any duties the Court ask. Get a reference of character from your part time employer. Get your solicitor to say nice things about what a wonderful lad you are. Don't ever do it again. Ever. Seriously.

What punishment am i looking at, shitting it I'm not sure what 51 reading is as ours is different, over here but it equates roughly to 1 pint ( 2 standard drinks) in your first hour and then 1/2 (1 standard drink) for each hour after that. I had 6 bottles of Becks (1.3 standards per bottle 1.3 x 6 =7.8 standards) over close to 5 hours. So i would of been allowed 7 standards in that period. I drove home as i knew i only had a 5 minute drive and the actual likelyhood of me blowing over would of been minimal. When you are touch and go you certaintly don't draw attention to yourself by driving with out a seat belt, foglights on and a mobile in ya hand. Maybe i shouldn't of driven home and when ever i'm that worried i will just catch a cab as i know the dangers, but i had done the maths and waited 30 minutes after my last drink and knew i wouldn't realistically blow over.

Your not just putting yourself at risk, but also other inocent lives' at risk! FFS man, take the punishment (knowing our government it will be next to nothing) and learn from this. Just like a post above though, there are other things that could easily endanger yourself and other people. For example, using a mobile phone and smoking, etc

Are you stupid or what? you say you are not defending someone and then go and defend them! Someone doesn't know what a devil's advocate is, clearly. Fair points though in my opinion. I'd guess many of the poster on here have drank a pint or two over a period of a few hours and driven home. Maybe zero tolerance is the best way to go. After all, once you've had a couple you're judgement is impaired as to actually how much you can take. There's lots of factors that come into play, strength of the alcohol, time, your body mass, even whether you've been to the toilet. I have no idea what the limit is (other than it's 4 units - I'm assuming the breathalyser wasn't saying you had 51 units of alcohol in you, you'd be paralytic!) For me the other factors (fogs/phone/seatbelt) are just as bad. In fact the number of people I see on their phones whilst driving drives me insane! It's also one of my bugbears with a speed cameras - you can drive past a speed camera whilst on the phone, swerving from side to side, no seatbelt on, shades on at night - but so long as you're doing under 30 mph, then that's fine!
