So why no announcement of Pearson?

Under what legislation are you saying he can't work for anyone else? Is that an FA/league ruling because in contract law you can do what the hell you want as long as you are prepared to deal with the consequences.

Based on the fact that they hold his contract and on previous situations where managers have been unable to work until compensation and therefore the contract being cancelled, this is all provided they refuse to accept hiss resignation and continue to pay him.

I must admit I don't know much about contract law, but if they did that surely Pearson could go down the constructive dismissal route? :dunno:

He hasn't been dismissed.

I don't see how. They refused us permission and he then requested to speak with us. They then reluctantly let him. At no point have they come out and said that his position is now untenable even though you would think that it is now too far down the line for him to ever go back to Hull.

Maybe but it's was he who asked to speak to us so I don't see how they could prove it besides he would have been dismissed if they're are still paying him.

Is this the same thing that happened between arch rivals Birmingham and Aston Villa in the summer? And Alex just ended up resigning?

I understand that but he can walk away if he chooses. He's then in breach of contract and that is settled by arbitration or the civil courts.

I've heard pearsons being held at ransom..

To be honest I don't blame Hull for this because it's a win win situation for them as they could demand a lot of money off us for pearson or keep a good manager like Pearson at the KC"

And until it's settled he wont be able to manage another club, I don't profess to know all the ins and outs but it's pretty clear to me that resigning wont help or resolve the current impasse if they're not prepared to accept it

Oh yeah.

Is there not anything he could do in this situation, as interviewing another person for his job seems pretty harsh?

Or could they really keep him in an indefinate limbo?

Could it be not only due to compensation, but also because Hull are looking for a manager and don't want to go without a manager for a long period? I mean, if they loose Pearson they will have to do this themselves unless they are going for a free manager.

Not all's well with Pearson to #lcfc Hull holding out for more money, #lcfc not happy to pay it and no official approach has been approved

Bugger

Damn. That is real bad news.

This is all starting to leave a bitter taste. I understand the hardball tactics, however I don't remember us playing such hardball over Fryatt, Hobbs, Waghorn, Pearson, Walsh, Shakespear.

It might be a good business tactic to haggle but there are many businesses, there are far less football clubs at a similar level. A bit of decorum wouldn't go amiss!

We should stop messing about right now and give the job to Mark Hughes, better manager, no compensation. Hull are stuck with the dour man. Win/win situation.

I think if nothing gets done tomorrow we should just tell them to get lost.

I thought we all wanted Championship experience? I hear that all the time, yet you want Mark Hughes. I would complain at that appointment like, but I'd rather have Billy Davies if we cannot get Nigel back.

And have a Tevez on their case?

Well not that bad but I think he

wouldn't have his full heart in

the job though....

Whats the obsession with Championship experience? Ian Holloway had that in abundence and got us relegated.

A good manager can manage at any level. Granted Sven made many mistakes, but it doesn't mean we have to go back and get Nigel Pearson. :frusty:

Also how much compo would you have to pay on a 18 month £500,000 contract?

Would it really be more than £1,000,000 (i.e. more than your earnings?

"Finally, at the time of termination, if there is any exchange of letters between the employer and the employee, it would appear that the employer will need to expressly state that the garden leave provisions will be relied upon. Otherwise, as in the case of Hutchings -v- Coinseed Limited 1998, an exchange of letters may have the effect of varying and even overruling the terms of an express garden leave clause with the result, in that particular case, that Ms Hutchings was able to take up work and indeed be paid for working for a competitor whilst also able to recover a notice payment from her existing employers!

Conclusion

To rely on such clauses employers need to ensure that they have appropriately drafted clauses in their contracts of employment and that they exercise their right to place employees on garden leave carefully. Failing this, employees need not assume that, by merely being placed on garden leave, they are prevented from doing anything and should seek legal advice as to their rights and obligations during this garden leave period."

I would think a manager's contract would include a provision for gardening leave wouldn't it? If it doesn't, he can walk away and they can't stop him finding employment elsewhere.
