Someone could easily have a heart attack or fall over in panic.

Reasonable force could be used to stop the attack, in this instance a high amount of force would be acceptable as the victim is in danger of suffocation but once the attacker stops no further force can be used except to restrain. Of course in extreme circumstances murder is lawful if that's the only option that would stop the attack. If i was confronted by this scenario I would dial 999 shout out the location and then help the victim or I hope that's what i'd do you never know till you are confronted by such a situation. If the attacked had a more lethal weapon I'm not sure I would be as brave but the fire extinguisher has to be the best option, what a star they were.

Murder is never lawful, otherwise it wouldn't be murder, if you murder someone you are breaking the law, if you kill someone without intent to kill, but were committing a crime or being reckless in the process it would be voluntary manslaughter and tried as such, if you kill someone by accident or in justifiable self defence it is involuntary manslaughter and not a crime.

Indeed but the fact it seemed like the natural thing to do makes me think he's more likely to tweet it or something. Also, if it was to get evidence, he should do other things first. I'd like to think I'd boot the attacker in the face once as hard as I could, try and knock him out or do his nose some damage so he's distracted from strangling the guy, then ring the police and try and restrain him. Least I would do is ring the police and try and stop the guy getting killed. Or maybe I would grab the fire extinguisher (I'm surprised they didn't stop when they saw the guy with the fire extinguisher coming at them, if he swung it it would have done some serious damage).

I'm not subject to violence at all but I'll always step in if I see someone taking a kicking, I'd hope I would do the same here.

Yes I should have put 'killing' someone is lawful rather than murder.

If someone is being murdered in that kind of scenario there is more than likely a good reason for it. It's not like we're talking about robbing an elderly lady or something where the victim is obvious and defenceless.

StanSP Posted 7 March 2013 Posted 7 March 2013 I bet that last guy who took the picture put it straight on a social networking site. Surely you just have to call help i.e. 999/emergency number first then get the evidence?! Get help first before it's too late and then get the pictures. But, fair enough for those who tried to stop the 'attacker'. At least they're trying to be productive and helping.
