Who else got a 'parking ticket' in the estate off Upperton Road tonight. Is it ligit?

Unless it’s issued by the council don’t pay it,they will threaten you with dvla etc,

but unless it’s enforced by the council you don’t have to legally pay it,

check the Martin Lewis website,

i did I didn’t pay nor intend to pay some fines I received

Out of interest, do you know if any of the non-council companies have access to the database to find your address? I know with some of them they can only start to chase payment if you get in touch with them to contest it and give them a means of contacting you.

They will pay £2.50 and request your information from the DVLA. So you are likely to receive a letter.

 

What you received is an invoice and not a fine. 

 

Dont pay and ignore the fake solicitor letters which is sent from the same address and guy at that ‘parking’ company just under a different name.

The company running the parking at js in hinckley get your address from dvlc so they can send you a bill.  Not sure of the legality to force payment

Please contest them , don’t ignore , some of these companies have been wining court cases recently

if you ignore it you could find yourself with  a CCJ 

 

In 2015 Supreme Court ruled against Barry Beavis in his legal challenge to ParkingEye’s right to issue penalties to motorists, so they are enforceable now. 

 

But they can be beat

I would say that they must have access to a database as that’s how they got my address,

If it’s a parking charge notice it isn’t legally enforced,

people pay the fine but you don’t have to,the cost of admin,plus court fees etc for them makes it pointless to Perdue you,

as there’s no guarantee they would win in court,

ive had letters before,then they offer you a discount rate,it’s all crap,

now they don’t bother me at all,hope this helps

Similar thread somewhere on here a few weeks ago.

 

The law changed re these so be careful, I got out of one a few years back by replying to the letter saying I wasn’t driving but I’m not telling you who was. Never heard back from them.

Yes the law changed and they can win now 

 

basically they issue an invoice and you become a debtor , they then can pursue that debt in court via a civil case. 

 

But if you write and say it wasn’t you driving they need to prove who was as legally you don’t have to say , but if it goes to court and you commit perjury in court and later are found to have done so then the penalty is often imprisonment !

 

one woman shopped her ex husband after they divorced and he got banged up for it she provided a bank statement that showed a petrol purchase on his bank card on the day the car was parked illegally , he got 6 weeks for it

 

just write in and say you were not driving and you are unclear who was and leave it at that 

 

99% of the time that will be the end of the matter

Yes. These companies have access to the DVLA database. 

 

There are certain rules that the parking companies have to adhere to, but if they do, then they can get the owner's address and make them liable for the charge. 

 

In my experience, the parking company I was dealing with, didn't adhere to the rules but still got access to the database. I pointed this out to the DVLA, they didn't care. 

 

It's another reason to be sceptical about trusting government agencies with your data.

The Protection of Freedoms Act 2012 is worth checking. They don't need to know the driver if the parking cowboys follow the procedure.

My solicitor who was advising me told me that story , I was taken to court by a company called parking eye , I had told them it wasn’t me driving but my brief told me not to risk that claim in court if it wasn’t true , and he told me that story 

 

for the record I paid the fine and the £125 court fees/costs , I didn’t want to go to court (again!)

Wrong.

 

a CCJ is only issued when you are taken to court and then still  DONT pay.
