The Club is pleased that it successfully defended the Premier League’s challenge to the Appeal Board decision in relation to the PSR assessment period ending FY23, which was the main focus of these proceedings.

The Premier League’s own rules provide a deliberately high threshold for any challenge to the decision of an Appeal Board. In this case, the Appeal Board’s decision was only capable of being overturned if it could be shown to have resulted from a “perverse interpretation of the law” or was a decision “which could not reasonably have been reached”.
 

The Appeal Board decision was reached by a highly experienced panel (including two former Court of Appeal judges) and, although the tribunal may have disagreed with the decision, it dismissed the Premier League’s challenge, finding (consistent with the arguments made by the Club all along) that the Appeal Board decision “could not sensibly be seen as resulting from a perverse interpretation of the law”.
 

The tribunal also concluded that the Premier League was successful in establishing jurisdiction on one of the two grounds argued by the Premier League with respect to the assessment period ending FY24, and the Premier League has now referred this to an independent Commission. Consistent with its previous commitments, the Club intends to engage cooperatively in this matter now that the Premier League’s jurisdiction has been established for the period ending FY24. However, we will not be able to comment further on these proceedings until they are concluded, due to their confidential nature.

I wonder if they’ll try and argue that the ruling was changed after we’d completed 23/24.

We broke the rules accept it, but the uncertainty turns it into a perpetual issue.

Feels weird that they can change the rules after the event and then go after us. 

More examples of made up rules being changed and made on the fly by all

We need maximum exposure right now to how inept the clubs hierarchy are. This is the perfect exposure.

Isn’t it ironic that they brought PSR in to improve the game we all love, and all it’s done is kill it totally. I’d actually rather go back to the closed shop top 6 then have to keep reading about another alleged breach of a smaller club like ours.

 

Having said all that, the club is nothing short of a joke. They only have themselves to blame. I feel so totally detached from this shitshow.

Not sure he can be sacked though, however if he is not prepared to oversee systemic change then he should accept it’s time to step back and either sell up or appoint someone to oversee the running of the club, he can still be the owner but step back from being chairman.

I would imagine the lawyers will look at that as an ex post facto ruling.

This club is a joke. 

 

The board cannot survive this, surely. 

Any right minded owner / majority Shareholder of any organisation would not want to avoid these costly legal battles that seem to negate the possibility of success and profitability. You would restructure and hold people accountable. 
 

This is dereliction of duty and self sabotage but he just seems so oblivious to it. The board survives because Top probably has no connection to the industry other than through JR and is reliant on him to do or change anything and we know JR wouldn’t entertain a DOF under Potter which seemed like a much needed logical change. 
 

We currently sit here not knowing RVN’s future. While Ipswich and Southampton look organised already ahead of the new season, months away, we again know that the board will delay and dither. I’ve discussed at length managers we could go for Rohl etc but who in their right mind will want to deal with this mess when it’s clear for anyone that this board is incompetent and can’t be trusted. Your long term journey here is unpredictable or short, everything is planned on a myopic whim, we’ll throw bad money after bad now become our new manager / player.

Lawyers and Silks are the the only winners when people can’t play nicely together!

 

I hope he strings it out again and wins it for us, because the EPL and EFL are just as amateur as our board.

So bored of reading about us breaching financial rules, that no other club seems to be as flippant/consistently arrogant towards.
