This crap about a community sentence being an option for killing another person with a gun is at least put to bed. Negatives: He is out in 2 years to continue his life as before. He will no doubt be quite comfortable in the hospital wing of the jail not with the general population. A lot of people still think he is innocent of everything cos he thought he was killing an intruder. All in all I think the next two years of his life will in many ways be esier than the last one has been.

In all fairness your wouldn't expect any criminal with no legs to serve there time in general population would you.

Well the International Paralympic Committee say they won't let him compete for five years so, providing they stick to their word, he won't be able to compete until he's 32/33 and on the decline. Prima facie 10 months does seem lenient, but he's suffered plenty already, will have to live with what he's done for the rest of his life, his career is in tatters and he won't reoffend, so I can see the judge's logic.

MPH Posted 21 October 2014 Posted 21 October 2014 There's a whole gamut of reasons why someone would fire a gun in someones direction without the intent of killing them. that is completley 100% inaccurate. I live in the U.S and I was trained that you never EVER point a gun at someone without the intent to harm or kill. You are only legally allowed to fire your gun into the ground as a warning shot not even into the air as people can be struck by them falling to the ground and indeed have been in the past and killed). The very second someone points a gun at you, then you are protected by law to fire at them and kill them with no retribution because, as if a gun is pointed at you, the law considers your life to be in imminent danger. A cop is trained to shoot to disarm and then eventually kill if need be, but Pistorious wasnt a cop and i also appreciate it wasnt in America so there is a chance of different gun laws. However to make a statement saying that there is a gamut of reasons why someone would shoot at someone without the purpose to kill them is wildly innacurate. It also shows a lack of knowledge in the power of a Gun in an untrained hand. Also If he had used a .22 caliber gun than you might have a point - that gun is likely to annoy someone more than endager their life but he used a gun with 9mm ammo which is much more powerful and is only intended to harm and kill. Even if it is claimed that it was self defence.

When you can legally have anti car-jack flame-thrower's to incinerate machete yielding crims trying to clean your windscreens i would have thought 5 years for a bit of drunken gun-slinging was a bit harsh.

Yes it's true, but anybody who commits a crime of that nature has to live with it for the rest of their lives, that doesn't mean they should face a more lenient sentence though, in my opinion. The judge has bought his sob story and felt under pressure due to his profile. The argument that prison couldn't accomodate him doesn't wash with me either. He's a professional athlete, not a frail old lady. Should have been at least 10 years and i'm in no doubt that under English law he would be.
