Rather than agreeing to the fee per se, the parties simply have to agree to a determination procedure, in case of dispute that would simply be determined by an independently qualified individual to act as an expert (most likely a lawyer of at least ten years PQE relevant experience, appointed by the president of the law society). the problem here is the image rights and the role of the agent is more so an objective test and allowing for dispute resolution after the event would allow the parties to gather relevant evidence without need to rush it through, to allow the expert to determine the outcome.
