If FIFA reject the transfer and leave Silva in limbo - neither able to play for us or Porto, and therefore for nobody - couldn't that face a legal challenge on the basis of  "restraint of trade" sort of thing with regard to Silva's personal position?

Not sure about that one, I think their point would be the trade has been made and he's now a leicester player, he just can't get on a pitch until January.

As for cancelling contract, no. To register an out of contract player, their contract needs to have ended prior to the close of the transfer window. They also don't look kindly on people trying to do that sort of thing and have lots of other rules in place to combat it.

If it's rejected and Silva's registration is still viewed as with Porto, can't they agree to cancel his contract? That would make him a free agent and therefore eligible to be engaged by us.

Think I'm clutching at straws!

Porto? lol

Better porto than benfuka !!  the SCP boys would be livid with that error !!

Yes.

If he said it was from benfuka cvnts I would start to calling him a foker nottingham forest fan!

Since it's not that bad I just say he should learn who's the portuguese biggest Club and who owns the best football academy in the world, that produced two Ballon d'our winners.

It would be a disgrace for it not to go through if it was a few minutes delayed. Not because of the clubs but because the player shouldn't be left in limbo, his career shouldn't be put on hold because someone has decided to apply the letter of the law.

Fair enough if it's an hour or so but if everything was agreed in principle within the correct time that should be enough. A bit like speeding in a 30mph zone when you don't get prosecuted for 35mph or less but technically you've still broke the law but it's considered within acceptable limits.

Except MrsG got done for doing 33 in a 30 limit.

So who knows

Mercury says decision due by end of tomorrow, so we can probably stop constantly refreshing now

On your first point, the phrase "restraint of trade" refers not to the transfer but to his profession. FIFA would be preventing Silva from plying his trade as a footballer by denying him the ability to make himself available for team selection, which is an essential part of his profession.

What really interests me is how we might be able to turn a negative into a positive in the event of the signing falling through.

Will James stay fit and continue to gain sharpness? He's going to struggle to emulate 15/16 Drinkwater, but what we really need right now is for him to emulate 16/17 Drinkwater, and there are signs that he can.

Will Ndidi regain his early form? Do we have a recall on Barnes? Could Maguire advance into midfield, if any two from Morgan, Huth, Dragovic are deserving of a place at the back? Has Amartey learned from his experiences last year? Can Iborra do the box-to-box role? Might we consider a longer-term change of shape to a 4-2-3-1, with more offensive wingers and two DMs? Will we look to sign an out-of-contract stop-gap? Will we retain Silva's registration to give us a mid-season boost? Will behind-the-scenes changes occur which may lead to a greater efficiency in our recruitment process?

A lot of good may yet come from it.

Just been reading up on De Gea's collapsed transfer to Real Madrid. That was point blank refused by the Spanish Football Association as they have no extended time to get a deal done, it didn't even get to FIFA to make a decision and it was reported to be off within hours of the window closing. Man Utd claim they had proof they submitted the documents on time but it doesn't appear Real Madrid were that bothered, they certainly didn't appeal it. What goes in our favour is we have 2 hours extra to conclude a deal, Sporting also want this to go through and the fact we're a few days on and a decision hasn't been made shows it's not clear cut that it should be rejected. I hope any confusion means it favours what both teams want which is Silva signing for us.

So a quick summary:

Sporting have 27m of our money in their bank a/c.

Silva is our player but may not be able to until January.

That right?

It is a bit odd. You’d think that either a) everything was done in time, he is Leicester’s player or b) everything wasn’t done in time, he remains Sporting player.

But somehow we could potentially be in a alternative dimension where he is neither?

He'd still be getting paid though, so I'm not sure how that works.

It's all Ross Barkleys fault for changing his mind last minute - the twat

But he would not be entitied to win bonuses and other incentives that may be payable if he were able to play.  So he is at least partially restrained which ever way you cut it.
